BUREAU OF INTERNATIONAL LABor AFFAIRS SALARIES AND EXPENSES For expenses necessary for the conduct of international labor affairs, $856,000. MANPOWER ADMINISTRATION MANPOWER DEVELOPMENT AND TRAINING ACTIVITIES For expenses necessary to carry into effect the Man- power Development and Training Act of 1962, as amended (42 U.S.C. 2571-2620), and for the performance of the functions of the Secretary in the fields of automation and manpower, $3827,906,000, te be mimediately available $507 ,906,000. BUREAU OF APPRENTICESHIP AND TRAINING For expenses necessary to enable the Secretary to con- duct a program of encouraging apprentice training, as author- ized by the Acts of March 4, 1913 (5 U.S.C. 611), and August 16, 1937 (29 U.S.C. 50) , $5,541,000. LIMITATION ON SALARIES AND EXPENSES, BUREAU OF EMPLOYMENT SECURITY For expenses necessary for the general administration of the employment service and unemployment compensation programs, not more than $13,325,000 may be expended from the employment security administration account in the Un- employment trust fund, of which $1,605,000 shall be for carrying into effect the provisions of title IV (except section 602) of the Servicemen’s Readjustment Act of 1944. LIMITATION ON GRANTS TO STATES FOR UNEMPLOYMENT COMPENSATION AND EMPLOYMENT SERVICE ADMIN- ISTRATION For grants in accordance with the provisions of the Act of June 6, 1933, as amended (29 U.S.C. 49-49n), for carrying into effect section 602 of the Servicemen’s Re- adjustment Act of 1944, for grants to the States as author- m 0 bo be on 10 11 12 13 14 15. 16 17 18 19 20 21 29, 23 24 29 4 ized in title III of the Social Security Act, as amended (42 U.S.C. 501-503), including, upon the request of any State, the purchase of equipment, and the payment of rental for space made available to such State in lieu of grants for such purpose, and for expenses not otherwise provided for, necessary for carrying out title XV of the Social Security Act, as amended (68 Stat. 1130), $455,076,000 may be ex- pended from the employment security administration account in the Unemployment trust fund, and of which $36,000,000 $22,000,000 shall be available only to the extent necessary to meet increased costs of administration resulting from increases in the base salary rate in excess of the rate in the fiscal year 1965 appropriation request, and from changes in a _ State law or increases in the number of claims filed and claims paid or increased salary costs resulting from changes in State salary compensation plans embracing employees ot the State generally over those upon which the State’s basic grant (or the allocation for the District of Columbia) was based, which increased costs of administration cannot be provided for by normal budgetary adjustments: Provided, That any portion of the funds granted to a State in the current fiscal year and not obligated by the State in that year shall be returned to the Treasury and credited to the account from which derived: Provided further, That such amounts as may _ be agreed upon by the Department of Labor and the Post 10 ii 12 14 15 16 17 18 19 20 21 23 24. 5 Office Department shall be used for the payment, in such manner as said parties may jointly determine, of postage for the transmission of official mail matter in connection with the administration of unemployment compensation systems and employment services by States receiving grants herefrom. Grants to States, next succeeding fiscal year: For mak- ing, after May 31 of the current fiscal year, payments to States under title TTT of the Social Security Act, as amended, and under the Act of June 6, 1933, as amended, for the first quarter of the next succeeding fiscal year, such sums as may be necessary, the obligations incurred and the expenditures made thereunder for payments under such title and under such Act of June 6, 1933, to be charged to the appropriation therefor for that fiscal year: Provided, That the payments made pursuant to this paragraph shall not exceed the amount paid to the States for the first quarter of the current fiscal year. UNEMPLOYMENT COMPENSATION FOR FEDERAL EMPLOYEES AND EX-SERVICEMEN For payments to unemployed Federal employees and ex-servicemen, as authorized by title XV of the Social Security Act, as amended, $126,000,000. COMPLIANCE ACTIVITIES, MEXICAN FARM LABOR PROGRAM For expenses necessary to enable the Department to determine compliance with the provisions of contracts entered into pursuant to the Act of July 12, 1951, as amended, $800,000. SALARIES AND EXPENSES, MEXICAN FARM LABOR PROGRAM. For expenses, not otherwise provided for, necessary to carry out the functions of the Department of Labor under the Act of July 12, 1951, as amended (7 U.S.C. 1461- 1468) , including temporary employment of persons without regard to the civil-service laws, $800,000, or so much thereof as may be available, shall be derived by transfer from the Farm labor supply revolving fund. 10 11 12 13 14 15 16 17 18 19 ¢ Lapor-MANAGEMENT RELATIONS LABOR-MANAGEMENT SERVICES ADMINISTRATION For necessary expenses to carry out the provisions of the Welfare and Pension Plans Disclosure Act, as amended (72 Stat. 997) , the Labor-Management Reporting and Disclosure Act of 1959 (73 Stat. 519), expenses of commissions and boards to resolve labor-management disputes and other ex- penses for improving the climate of labor-management re- lations, $7,852,000 $7,502,000. BUREAU OF VETERANS’ RREMPLOYMENT RIGHTS For expenses necessary to render assistance in connec- tion with the exercise of reemployment rights under section 8 of the Selective Training and Service Act of 1940, as amended (50 U.8.C. App. 308), the Service Extension Act of 1941, as amended (50 U.S.C. App. 351), the Army Re- serve and Retired Personnel Service Law of 1940, as amended (50 U.S.C. WOMEN’S BUREAU For expenses necessary for the work of the Women’s Bureau, as authorized by the Act of June 5, 1920 (29 U.S.C. 11-16), including purchase of reports and material for informational exhibits, $772,000. WAGE AND HOUR DIVISION For expenses necessary for performing the duties im- posed by the Fair Labor Standards Act of 1938, as amended, and the Act to provide conditions for the purchase of supplies BS ao om -® Ww a] 10 11 12 13 14 15 17 18 19 21 22 23 24 9 and the making of contracts by the United States, approved June 30, 1936, as amended (41 U.S.C. 35-45), including reimbursements to State, Federal, and local agencies and their employees for inspection services rendered, $20,- 378,000. HMPLOYEES’ COMPENSATION SALARIES AND EXPENSES, BUREAU OF EMPLOYEES’ | COMPENSATION For necessary administrative expenses and not to exceed $113,600 for the Employees’ Compensation Appeals Board, $4,368,000, together with not to exceed $60,000 to be derived from the fund created by section 44 of the Long- shoremen’s and Harbor Workers’ Compensation Act, as amended (33 U.S.C. 944). EMPLOYEES’ COMPENSATION CLAIMS AND EXPENSES For the payment of compensation and other benefits and expenses (except administrative expenses) authorized by law and accruing during the current or any prior fiscal year, including payments to other Federal agencies for medical and hospital services pursuant to agreement approved by the Bureau of Employees’ Compensation; continuation of pay- ment of benefits as provided for under the head “Civilian War Benefits” in the Federal Security Agency Appropriation Act, 1947; the advancement of costs for enforcement of re- H.R. 10809-———2 He wo bo fam 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 10 coveries in third-party cases; the furnishing of medical and hospital services and supplies, treatment, and funeral and burial expenses, including transportation and other expenses incidental to such services, treatment, and burial, for such enrollees of the Civilian Conservation Corps as were certified by the Director of such Corps as receiving hospital services and treatment at Government expense on June 30, 1943, and who are not otherwise entitled thereto as civilian employees of the United States, and the limitations and authority of the Act of September 7, 1916, as amended (5 U.S.C. 796), shall apply in providing such services, treatment, and ex- penses in such cases and for payments pursuant to sections 4(c) and 5(f) of the War Claims Act of 1948 (50 U.S.C. App. 2012) ; $52,650,000, together with such amount as may be necessary to be charged to the subsequent year appropriation for the payment of compensation and other benefits for any period subsequent to March 31 of the year: Provided, That, in the adjudication of claims under section 42 of the said Act of 1916, for benefits payable from this appropriation, authority under section 32 of the Act to make rules. and regulations shall be construed to include the nature and extent of the proofs and evidence required to establish the right to such benefits without regard to the date of the injury or death for which claim is made. BUILDINGS AND FACILITIES For construction, alteration, and equipment, of facilities, including acquisition of sites, and planning, architectural, and engineering services, $10,875,000, to remain available until expended. OFFICE OF EDUCATION EXPANSION AND IMPROVEMENT OF VOCATIONAL EDUCATION For carrying out the provisions of titles I and IT of the Vocational Education Act of 1946, as amended (20 U.S.C. 15i-15m, 150-15q, 15aa-15jj, Public Law 88-210), section 1 of the Act of March 3, 1931 (20 U.S.C. 30), the Act of March 18, 1950 (20 U.S.C. 31-33), section 9 of the Act of August 1, 1956 (20 U.S.C. 34), section 2 of the Act of September 25, 1962 (48 U.S.C. 1667), and the Voca- tional Education Act of 1963; $488,296,000, te be immedi ately available $758,296,000, of which $5,000,000 shall be for allotment for practical nurse training under such title II 10 11 12 13 14 15 16 17 18 19 i) bo Ww tA 13 of the Vocational Education Act of 1946, $180,000 for vocational education in the fishery trades and industry in- cluding distributive occupations therein, and $30,000,000 for carrying ont sections 13 and +4 $5,000,000 for carrying out section 13 of the Vocational Education Act of 1963, and $118,500,000 for carrying out other provisions of that Act. HIGHER EDUCATION FACILITIES CONSTRUCTION For grants, loans, and payments under the Higher Edu- cation Facilities Act of 1963, $463,150,000, to be immedi- ately available, of which not to exceed $230,000,000 shall be for grants for construction of academic facilities under title I; $60,000,000 shall be for grants for construction of graduate academic facilities under tithe IIT; and $169,- 250,000 shall be for loans for construction of academic facilities under title TI. GRANTS FOR PUBLIC LIBRARIES For grants to the States, pursuant to the Act of June 19, 1956, as amended (20 U.S.C. 351-358; Public Law 88-269), $55,000,000, of which $25,000,000 shall be for grants for public library services under title I of such Act, and $30,000,000 shall be for grants for public hbrary con- struction under title IT of such Act. 10 11 12 ‘13 14 15 16. 17 18 19 20 21 22 23 24 14 FURTHER ENDOWMENT OF COLLEGES OF AGRICULTURE AND THE MECHANIO ARTS For carrying out the provisions of section 22 of the Act of June 29, 1935, as amended (7 U.S.C. 329), $11,950, 000. PAYMENTS TO SCHOOL DISTRICTS For payments to local educational agencies for the maintenance and operation of schools as authorized by the Act of September 30, 1950, as amended (20 U.S.C., ch. 13), $859;450,000 $332,000,000: Provided, That this ap- propriation shall also be available for carrying out the pro- visions of section 6 of such Act. ASSISTANCE FOR SCHOOL CONSTRUCTION For an additional amount for providing school facilities and for grants to local educational agencies in federally affected areas, as authorized by the Act of September 23, 1950, as amended (20 U.S.C., ch. 19), including not to exceed $820,000 for necessary expenses during the current fiscal year of technical services rendered by other agencies, $58,400,000, to be immediately available, and to remain available until expended: Provided, That no part of this ap- propriation shall be available for salaries or other direct ex- penses of the Department of Health, Education, and Wel- fare : Provided further, That applications filed on or before bo aS 8 e al 10 11 12 13 14 15 16 17 18 19 20 21 22 23 a4 15 June 80, 1964, shall receive priority over applications filed after such date. DEFENSE EDUCATIONAL ACTIVITIES Vor grants, loans, and payments under the National De- fense Education Act of 1958 (72 Stat. 1580-1605) , $287- 853,000, of which $136,000,000 shall be for capital con- tributions to student loan funds and loans for non-Federal capital contributions to student loan funds, of which not to exceed $1,000,000 shall be for such loans for non-Federal capital contributions, $66,600,000 shall be for grants to States and loans to nonprofit private schools for science, mathematics, or modern language equipment and minor re- modeling of facilities and for grants to States for supervisory and other services: Provided, That allotments under sections 302 (a) and 305 for acquisition of equipment and minor re- modeling shall be made on the basis of $61,600,000 for grants to States and shall be made on the basis of $8,400,000 for loans to private, nonprofit schools, and allotments under section 302(b) for supervisory and other services shall be made on the basis of $5,000,000; $15,000,000 shall be for erants to States for area vocational education programs; and $17,500,000 shall be for grants to States for testing, guid- anee, and counseling: Provided, That no part of this appro- priation shall be available for the purchase of science, oe f°; A 10 11 12 13 14 15 16 17 18 19 20 21 22 23 16 mathematics, and modern language teaching equipment, or equipment suitable for use for teaching in such fields of edu- cation, which can be identified as originating in or having been exported from a Communist country, unless such equip- ment is unavailable from any other source: Provided fur- ther, That no part of this appropriation shall be available for graduate fellowships awarded initially under the provisions of the Act after the date of enactment of the Department of Health, Education, and Welfare Appropriation Act, 1962, which are not found by the Commissioner of Education to be consistent with the purpose of the Act as stated in section 101 thereof. COOPERATIVE RESEARCH For cooperative research, surveys, and demonstrations in education as authorized by the Act of July 26, 1954 (20 U.S.C. 331-832) , $15,840,000. EDUCATIONAL RESEARCH (SPECIAL FOREIGN CURRENCY PROGRAM) For payments in foreign currencies which the Treasury Department determines to be excess to the normal require- ments of the United States, for necessary expenses of the. Office of Education, as authorized by law, $500,000, to re-. main available until expended: Provided, That this appro- priation shall be available, in addition to other appropria- tions to such agency, for payments in the foregoing cur- rencies. SALARIES AND EXPENSES For expenses necessary for the Office of Education, in- cluding surveys, studies, investigations, and reports regarding libraries; coordination of library service on the national level with other forms of adult education; development of library service throughout the country; purchase, distribution, and exchange of education documents, motion-picture films, and lantern slides; $48,599,000 te be immediately available $18,699,000. VOCATIONAL REHABILITATION ADMINISTRATION GRANTS TO STATES For grants to States in accordance with the Vocational Rehabilitation Act, as amended, $100,100,000, of which $97,100,000 is for vocational rehabilitation services under section 2 of said Act; and $3,000,000 is for extension and improvement projects under section 3 of said Act: Provided, That allotments under section 2 of said Act to the States for the current fiscal year shall be made on the basis of $175,- 000,000, and this amount shall be considered the sum avail- able for allotments under such section for such fiscal year: o> Or ee oo bo pt o fo xn 10 li 12 13 14 15 16 17 18 19 20 21 22 23 24 i9 Provided further, That additional allotments, not exceeding $900,000 in the aggregate, for grants under section 2 of said Act may be made, in accordance with regulations of the Secretary, to States in which the Federal share of the costs of rehabilitation services under such section exceeds their respective allotments from such $175,000,000: Pro- vided further, That the allotment to any State under section 3 (a) (1) of said Act shall be not less than $15,000. None of the funds appropriated by this title to the Welfare Administration for grants-in-aid of State agen- cies to cover, in whole or in part, the cost of operation of said agencies, including the salaries and expenses of officers and employees of said agencies, shall be withheld from the said agencies of any States which have established by legislative enactment and have in operation a merit system and classifi- cation and compensation plan covering the selection, tenure in office, and compensation of their employees, because of any disapproval of their personnel or the manner of their selection by the agencies of the said States, or the rates of pay of said officers or employees. The Secretary is authorized to make such transfers of motor vehicles, between bureaus and offices, without transfer of funds, as may be required in carrying out the operations of the Department. None of the funds contained in this Act shall be used for any activity the purpose of which is to require any recipient of any project grant for research, training, or demonstration made by any officer or employee of the Department of Health, Education, and Welfare to pay to the United States any portion of any interest or other income earned on payments of such grant made before July 1, 1964. SEC. 206. Lexcept upon the request of the Department of the Interior none of the funds herein appropriated shall be used to conduct or assist in conducting, or carry on, undertake, or continue surveys, investigations, or any pro- grams (including, but not limited to, the payment of salaries, administrative expenses, the conduct of research activities and policing actions) in the field of salinity control or of irrigation water quality in the States of Arizona, California, Nevada, New Meaico, Utah, Colorado, and Wyoming. TITLE NWI—NATIONAL LABOR RELATIONS BOARD SALARIES AND EXPENSES For expenses necessary for the National Labor Relations Board to carry out the functions vested in it by the Labor- Management Relations Act, 1947, as amended (29 U.S.C. 141-167), and other laws, $24,000,000: Provided, That no part of this appropriation shall be available to organize or assist in organizing agricultural laborers or used in connection with investigations, hearings, directives, or orders concerning bargaining units composed of agricul- tural laborers as referred to in section 2(3) of the Act of July 5, 1935 (29 U.S.C. 152), and as amended by the Labor-Management Relations Act, 1947, as amended, and as defined in section 3 (f) of the Act of June 25, 1938 (29 U.8.C. 203), and including in said definition employees engaged in the maintenance and operation of ditches, canals, reservoirs, and waterways when maintained or operated on a, mutual, nonprofit basis and at least 95 per centum of the water stored or supplied thereby is used for farming pur- poses. ee 51 TITLE IV—NATIONAL MEDIATION BOARD SALARIES AND EXPENSES For expenses necessary for carrying out the provisions of the Railway Labor Act, as amended (45 U.S.C. 151- 188), including temporary employment of referees under section 3 of the Railway Labor Act, as amended, at rates not in excess of $100 per diem; and emergency boards appointed by the President pursuant to section 10 of said Act (45 U.S.C. 160) ; $1,970,000. None of the funds appropriated in this Act shall be used to conduct or assist in conducting any program (including but not limited to the payment of salaries, admin- istrative expenses, and the conduct of research activities) re- lated directly or indirectly to the establishment of a national service corps or similar domestic peace corps type of pro- gram. Src. 906. None of the funds contained in this Act shall be used for implementing any provision of the Economic Opportunity Act of 1964.
