The sentence to be cashiered in the case of Captain William P Eagtn, 23d Regiment of Kentucky Volunteer Infantry, promulgated m Special Orders, No. 42, Headquarters, 2d Division, 21st Army Corps, Department of the Cumberland, is inoperative, in consequence of irregularities in the proceedings of the Court Martial. Tim record, however, shows a clear case of misbehavior before the enemy, and cowardice, and Captain Eagen is, therefore, dismissed the service of the United States, by direction of the President, to date from June 24 1863.
