The Department of Psychiatry and Biobehavioral Sciences at UCLA has under J.
consideration the proposed advancement of Dr. Kenneth Mark Colby from
Professor IV to Professor V. —— ee

Such advancement requires evidence of extraordinary service and accom- .
plishment, and implies national and international distinction. Accord- oo
ingly, I am writing to request that you provide me with your analysis ee
and evaluation of the contributions of Professor Colby as an educator,

a scholar, and a leader in his profession. It would be particularly helpful
if you would compare him with others by describing his standing in the

field, and discuss his publications with reference to their originality

and significance. For your convenience, I am enclosing a copy of Professor
Colby's bibliography.

Your letter will become part of the official personnel file. Under a
recently enacted California statute the candidate, upon request, may,
because of the academic position involved, be entitled to have access

to the complete text of your letter, with only your name and affiliation
deleted. In the view of the University, this statute is an unconstitutional
impairment of the University's delegated powers of governance under the
California Constitution, and this issue will be litigated. Pursuant to
the University's current policy and pending the outcome of litigation,
your letter will be held in confidence, and the candidate will not be
given access to it. The candidate will, upon request, be provided with

a summary of the substance of the confidential evaluations in the review
file, without disclosure of the sources. We wish to emphasize, however,
the possibility that the candidate may eventually have the right of access
to the complete text of your letter, with only your name and affiliation

deleted.
