The Secretary may provide all necessary technical ‘and other nonfinancial assistance (including the preparation of prototype plans of organization add opera- tion) to nonprofit private entities {including entities pres ently receiving financial assistance under section 314 (b), title IX, or as an exper imental health service delivery sys- tem under section 304) w hich— aH (1 ) express a desire to be designated as health systems agencics, and . “(2) the Secretary. determines have a_ potential . to meet the requirements of a health systems agency specified in sections 1412 and 1413, to assist such entities in developing applications to be sub- mitted to the Secretary under section 1415 and otherwise m preparing to mect the requirements of this part for designa- tion as a health systems agency. “DESIGNATION OF HEALTIL SYSTEMS AGENCIES “See. 1-415, (a) At the earliest practicable date after the establishment under section 1411 of health service areas, | the Secretary shall enter into agreements in accordance with this section for the designation of health systeins agencies for such areas, “(b) (1) The Secretary may enter into agreements: with cutities under which the entities would be initially designated a as the health systems agencies for healuy service areas ona eee eee: Seem we DR ECE RO ALS a RE Iam te BILLS H_ 58 “(7) The special needs and circumstances of those. entities which provide a substantial portion of their services or resources, or both, to individuals not residing in the health service area in which the catity is located or. in adjacent health service areas. Such entities may in- clude medical and other health professions schools, multi- disciplinary clinies, specialty ‘ centers, and such other entitics as the Secretary may by regulation prescribe. (8) The special needs and circumstances of health maintenance organizations for which assistance may bo provided under title XIII. “(9) In the ‘case of a construction project “(A) the costs and methods of the proposed construction, and ” “(B) the probable impact of the construction project reviewed on the costs of providing health services by the provider or other person proposing such construction projeet. | “PECUNICAL ASSISTANCE FOR IEALTH SYSTEMS AGENCIES AND STATH NEALTH PLANNING AND DEVELOPMENT AGENCIES “SEC. 1433. CENTERS FOR UEALTIL PLANNING “Sno, 1434. To the extent practicable, the Sceretary shall provide assistance under this section so that at t least five such eenters will be in operation by Tyne 30, 1976, “(b) (1) No grant or contract may be made under this section for planning or developing’a center unless the Secre- tary determines that when it is operational it will mect the requirements listed in paragraph (2) and no grant or con- tract may be made under this section for operation of a eenter unless the center mects such requirements. “(2) The requirements referred to in paragraph. (1) are as follows: (A) There shall be a full-time director of the cen- ~ fer who possesses a demonstrated capacity for substan- tial accomplishment and leadership jn the field of health planning and resources development, and there shall be such additional professional staff as may be appropriate. ““(B) The staff of the center shall represent a diver: sity of relevant disciplines. ““(C) Such additional requirements as the Scere: tary may by regulation prescribe. ‘ . . . - *(c) Centers assisted under this section may (1) enter — - into arrangements with health systems agencies and State © Agencies for the provision of such services as may be appro- spree de ee enemas: ce eA Me ete tint me a ren ge te ieee eee oe BILLS H- 62 priate and necessary in assisting the agencies and State Agen- Bs cies in perfonning their functions under section 1418 or 1423, respectively, and (2) shall use methods: (satisfactory to the Secretary) to disseminate to such agencies aid State Agen- | cies such planning approaches, methodologies, policies and standards as they devclop.: “(d) For the purpose of making payments pursuant to ‘grants and contracts under subsection (a) there are author- ‘ized to be appropriated $5,000, 000 for the fiscal year end- ‘Ing June 30,. 1945, 88, 000, 000 for the fiseal year ending June 30, 1976, and. $10,000,000 for the fiscal year endine June 30, 1977: “REVIEW BY THE SECRETARY os “Spo. 1435. Jn making such review and approval or disapproval the Secretary shall con- sider the coniments of Statewide T eaJth Coordinating Coun- tils submitted under section 1424 (c) (3). es “(b) The Secretary shall prescribe performance stand- ards covering the structure, operation, and performance of the fuuctions of each designated health systems agéncy and éach State Agency, and he shall establish a reporting system based of the performance standards that allows for contin- uous review of the structure, operation, and performance of ~ the functions of heajh systems agencies.
