BY-LAWS OF THE SOUTHERN DISTRICT NEW-HAMPSHIRE MEDICAL SOCIETY. NASHUA: PRINTED AT THE GAZETTE OFFfCE, 1839. BY-LAWS. SECTION I. Of Officers, Meetings, §c* Art. 1. The Society shall meet semi- annually, on the second Tuesday of June, and the second Tuesday of January, at ten of the clock, A. M., the former of which shall be considered the anniversary, at which time there shall be elected by written ballots, a President, Vice-President, three Counsel- lors, Secretary, Treasurer and Librarian; a majority of votes to determine the choice. 2. No person, not a member of this So- ciety, shall attend any meeting, except be be a member of some incorporated Medical Society, and be admitted by a vote of the members present. 3. In all meetings of> the Society a ma- jority shall govern. 4. No member shall be eligible to the office of President more than three years successively. 5. No member shall be eligible to the office of Counsellor who is Counsellor w. the General Society. 4 SECTION II Order of Business. Art. 1. As soon as the presiding officer shall have declared the meeting open, the Secretary shall read the minutes of the last meeting, and report the unfinished business. 2. Patients admitted for examination. 3. Communications made; Dissertations. 4. Place of the next meeting appointed. 5. Meeting adjourned. SECTION III. Rules of Decorum. Art. 1. The President shall not leave the chair, unless on some urgent occasion, or speak to any question without first obtain- ing permission of the Society. 2. No member shall speak in debate with- out rising and addressing himself to the President. 3. No member having spoken once in de- bate shall speak again to the same question without leave of the Society. 4. Every member, as soon as he has done speaking, shall sit down. 5. No member shall speak on a subject after the question is decided. 6. No member shall interrupt another while speaking, unless to call him to order, or correct a mistake. 5 7. No motion shall be considered unless seconded. 8. No member shall nominate more than one for the same committee, provided the first be chosen. SECTION IV. Duties of the President and Vice-President. Art. 1. It shall be the duty of the Pres- ident to preside in all meetings oi" the Soci- ety, preserve order and decorum, determine all questions of order; yet any member be- ing dissatisfied with his decision, may appeal Co the Society, whose decision shall be de- termined by yeas and nays. 2. He shall take the sense of the Society upon every motion made and seconded ; and shall have a casting vote in all cases when the votes are equally divided. 3. In the absence of the President, the Vice-President shall preside and possess all the authority of the President. SECTION V. Duties of the Counsellors. Art. The Counsellors shall meet semi- annually on the second Tuesday in June, and the second Tuesday in January, at the place where the Society holds its meeting on the same day, at eight of the clock, A. M. 6 to try and determine all controversies, ot which this Society have original or final ju- risdiction, and may adjourn to such time and place as may suit their convenience and the convenience of the parties, two of whom shall constitute a quorum to do business ; at which meetings the senior Counsellor present shall preside. 2. The President and Counsellors are empowered to call a special meeting when- ever they shall deem it expedient. SECTION VL Duties-of the Secretary. Art. 1. The Secretary shall note the members present, take minutes of all the proceeding of the Society, and keep a re- cord of the same ; attend u\\ meetings of the Counsellors, take minutes of all their proceedings, and keep a fair record of the same, and in case of an appeal, make out and forward the necessary papers, and per- form all the duties prescribed for him in Sec- tion X, Art. 1, ^Section XI, Art. 5, and Sec- tion XIII, Art. 4. 2. He shall give notice to every new mem- ber of his admission, keep the Cabinet, and attest all writings. 3. He shall answer all letters directed to the Society and write such as they may di- rect. Pi 4 4. Ho shall'annually transmit to the Sec- retary of the General Society a full and correct copy of all the proceedings of the- Society. SECTION VII. Duties of the Treasurer. \ Art. T. The Treasurer shall give bonds to the satisfaction of the Society for the faithful discharge of his duty. 2. He shall receive all monies due to the Society, keep a fair record of the same, and pay them out from time to time, by order of the Society, and render his account at the anniversary meeting to a committee chosen for that purpose, whose report, when ac- cepted, shall be recorded by the Secretary. 3. He shall write to each delinquent mem- ber, after two taxes shall have become due, informing him of the sum due, desiring him to make payment; and if any member shall neglect to make payment one year after such notice, he shall, lay the same before the So- ciety. SECTION VIII. Duties of the Librarian and Regulations of the Library. Art. 1. It shall be the duty of the Libra- rian to keep a catalogue of all the books be- longing to the Society, the prices paid for H 1 hem ; if a donation, the name of the donor ; he shall enter the name of the Society in each book, and if a donation the name of the donor. 2. He shall note any injury a book may sustain while out of the Library, and the member who had il in his possession; and the damage shall be estimated by a com- mittee, whose duty shall be to inspect the Library and make report to the Society, on the day of the anniversary meeting. 3. If any book, while in the possession of a member, be lost, he shall procure another for the Library, if it be a part of a set, he shall take the remainder of the set, and pro- cure a new set for the Society. 4. Any member thinking himself injured by the judgment of the inspecting committee may appeal to the Society, whose decision shall be final. 5. Each member shall be entitled to re- ceive three volumes at a time from the Li- brary, to be returned as follows, viz:—at the anniversary meeting in June, and the semi-annual meeting in January; and in case of failure, shall pay a fine of ten cents a month till returned. 6. All books shall be returned to the Li- brary by one o'clock, P. M. at the anniver- sary meeting, for the purpose of inspection ; and should any member neglect to make 9 such return by said time, he shall pay a fine of fifty cents for his neglect. 7. All fines for the breach of the Library laws and assessments for damages, shall be paid to the Librarian, who shall pay the same to the Treasurer at every annual meeting. 8. No member shall be entitled to take a book from the Library, who has incurred a fine, and has for more than one year neg- lected to pay the same, or has two years' taxes charged against him. SECTION IX. Duties of Members. Art 1. It shall be the duty of each mem- ber to promote the honor and interest of the Society so far as in his power; and he is requested carefully to observe in his profes- sion such occurrences as are worthy of re- mark, and to make communication of the same to the Society in writing. 2, Each and every member shall vindi- cate the character of his fellow member, as far as justice and propriety will admit, both in public and private. 3. Each and every member shall attend punctually and give advice freely with all consultations with each other, but shall not encourage any empirick or pretender, but use all lawful means to discourage and pre- vent their imposing upon mankind. And if 10 in any case, a difference of opinion should arise, as to the necessity, or propriety of holding consultations, with any person prac- ticing medicine, the case shall be referred to the counsellors. 4. No member shall visit the patient of a fellow member under pretence of calling as a friend or neighbor, for the purpose of in- sinuating himself into the favor of the pa- tient or his friends, to the detriment of a fel- low. 5. No member shall visit, bleed, extract teeth* or administer medicine in a family who usually employ a fellow member, gra- tis, or for a less fee than he usually charg- es, unless the indigence or circumstances of the patient shall justify the same. 6. No member shall be censured for the part he may have taken in debate, provided he keep within the rules of order, or for the vote he may have cast in taking the sense of the Society on any question. 7. Two members shall be chosen at each meeting to present a Dissertation on some subject relative to the profession ; which Dissertation shall be read before the Socie- ty at their next meeting, and a question may be proposed to be discussed at a future meeting. ■ SECTION X. Complaints, to whom made. Art. 1, All complaints for the violation 11 of the By-Laws, and Regulations of the General Society, of which this Society have original jurisdiction, and all complaints for the violation of the regulations of this Soci- ety, shall be made to the Secretary in writ- ing, which complaint shall distinctly specify the nature of the offence, the time when, and the place where the alleged offence was committed ; and it shall be the duty of the Secretary to make out an attested copy of all complaints thus made with a citation in form as follows, viz :—- To Dr. A. B. of€. You are hereby cited to appear before the Counsellors of the Southern District N. H. Medical Society, at on the second Tuesday of at 8 of the clock, a. m. then and there to answer to the foregoing complaint. Dated at this day of 18 D. E. Secretary. 2. The fellow or associate thus com- plaining, shall serve the fellow or associate thus complained of, with the attested copy of complaint and citation, by delivering the same to him in hand, or leaving it at his us- ual place of abode, at least fifteen days pri- or to the meeting of the Counsellors, and certify the same to the Secretary before said meeting. 3. Should any-fellow or associate, cited 19 as aforesaid, unnecessarily neglect to appear before the Counsellors, or the fellow or as- sociate complaining, neglect to appear to prosecute his complaint, the trial may pro- ceed exparte. SECTION XI. Certificates of Affidavits to be used as evi- dence, how taken, fyc. Art. 1. When it is inconvenient for wit- nesses to attend, certificates or affidavits may be received as evidence, provided the adverse party be notified agreeably to tho following article. 2. Should any fellow or associate wish to take the certificate of any person to be used as evidence in any case before the Counsel- lors, he shall give the adverse party season- able notice in writing, specifying the day, hour and place, and for what purpose the certificate or affidavit is to be taken, and de- liver an attested copy of such notice to the Secretary before the meeting of the Coun- sellors. 3. Certificates or affidavits may be taken to invalidate the testimony of any person, provided the adverse party be notified agree- ably to the foregoing article. 4. Any fellow being dissatisfied with the decision of the Counsellors, in any case for violation of the By-Laws and Regulations of the General Society, may appeal to the 13 Council of the General Sccietv, (vide By- Laws of the General Society, Chop. 4, Sec. 5. The Secretary shall report the decis- ion of the Counsellors to the Society in all cases where they have final jurisdiction, which decision shall be carried into effect unless two thirds of the members present shall vote against it, which shall be deter- mined by yeas and nays. 6. No complaint shall be entered one year after the offence shall have been made known to the person complaining. SECTION XII. Of Vacancies. Art. 1. In case of death or removal of any officer, the other officers or select com. mittee shall take charge of the effects be- longikg to said officer, and give receipts for the same ; which effects shall be delivered to the person who shall next fill the office vacated. SECTION XIII. Admission of New Members. Art. 1. Any person of good moral char- acter, who has been examined and approv- ed by some medical incorporated body, or shall have received a medical Degree at some University, may be elected an associ- ate at any regular meeting of this society.— It And if any .Licentiate'or Doctor in medi- cine, or anyother person practising medi- cine within the liinits of this society, shall hereafter refuse, or neglect, to obtain ad- mission as a member of this society, accor- ding to the method prescribed by the By- Laws, for more than six months after notice homg given of this 'regulation, by some member of the society, hs shall be -deemed an irregular practitioner and treated as such. But nothing contained in this article shall dc considered to affect in the least the rights of those regular practitioners who en- tered into practice previous to the year 1810. 2. The election of associates shall be by ballot, at any stated meeting of the society. 3. Every candidate shall first be propos- ed and recommended by at least one mem- ber to the officers, his name and place of abode delivered in by the proposer, one of the officers consenting thereunto; the same shall be read by the Secretary, and a copy thereof posted up in the room where the Society meet; and at that or any succeed- ing meeting, the candidate may be balloted for, and if two thirds of the ballots are in his favor, the choice shall be valid., 4. No individual elected into this society shall be considered a member, till he shall signify to the Secretary his acceptance in writing, and shall have signed the Consti- tution; and it shall be the duty of the Sec retary to instruct him accordingly, 15 SECTION XIV. Fines and Contributions. Art. 1. A member of this Society, who shall neglect to attend to ztny special duty required of him, as an officer or member, (he having consented thereunto,) may be fined in a sum not exceeding two dollars ; but for high offences he may be suspended or dismissed. 2. Each new member, on his admission, shall pay to the Treasurer two dollars, to be disposed of for the benefit of the institution. 3. The annual tax of each member of this Society shall be fixed at one dollar, to be paid to the Treasurer at every anniver- sary meeting. Alterations and Amendments, ADOPTED JUNE 9th, 1840. Amendment of Article Fourth, Section Sixth. The Secretary shall be required to trans- mit to the N. H. Medical Society such ab- stract only of the proceedings of this Asso- ciation, as the By-Laws of that Society des- ignate—anything in the 4th Article of Sec- tion VI. of these By-Laws to the contrary notwithstanding. Amendment of Article Fifth, Section Eighth. Members taking books from the Library may be allowed to retain them six months, 16 excepting that all books shall be returned at the Annual Meeting, subject to the same {)enalties for neglect as heretofore estab- ished. meetings of the Society. The Annual Meeting of this Society shall be holden at Amherst, on the Second Tues. day of May, in each year ; and the Semi-An- nual Meeting, at such time and place as may be determined by vote of the Society at the preceding meeting.
