SYNOPSIS OF THE LAWS. The Supervising Surgeon:-The Supervising Surgeon is charged by law, under the direction of the Secretary of the Treasury, with the super- vision of all matters connected with the marine hospital service of the United States. (Sec. 6, Act June 29,1870. 16 Stat., 170.) Assessment and collection of hospital-dues:-The customs officers of the several ports of the United States shall assess and collect from the masters or owners of every vessel of the United States engaged in the foreign or coasting trade, the sum of forty cents per month for each and every officer and seaman who has been employed on said vessel since last return of hospital-dues, which sum the master or owner is authorized to collect or retain out of the wages of said officers and seamen. (Sec. 1, Act June 29,1870. 16 Stat., 169.) Consular officers shall collect hospital dues on the sale or transfer of vessels of the United States in foreign ports or waters.-(Act April 29, 1864. 13 Stat., 61.) When hospital-dues are to be paid:-Masters and owners of vessels engaged in foreign trade shall render hospital-dues returns whenever entry is made at a port of the United States. (Sec. 1, Act June 29,1870. 16 Stat., 169.) Masters or owners of vessels engaged in the coasting trade are required to make said returns upon renewal of license or enrollment. (Sec. 2, Act June 29, 1870. 16 Stat., 169.) Penalty for making a false report:-Any master or owner of a vessel who shall make a false report of the number of seamen employed on his vessel, or of the length of time they have severally been employed, shall forfeit and pay fifty dollars for each and every offence, which sum shall be levied and collected by the customs officer to whom the report is made, and the same shall be credited to the marine hospital fund. (Sec 2, Act June 29, 1870. 16 Stat.) 169.) Accounts, deposits, and reports of hospital-money collectedThe several collectors shall keep separate accounts of the hospital-money collected by them, and shall deposit the same, without abatement, in the nearest 14 UNITED STATES MARINE HOSPITAL SERVICE. United States depository, to the credit of the marine hospital fund; and shall make monthly reports thereof to the Marine Hospital Bureau of the Treasury Department.-(Sec. 3-4, Act June 29,1870. 16 Stat., 170.) Application of the marine hospital fund:-The fund resulting from the collections of hospital-dues is to be expended under the supervision of the Supervising Surgeon, for the relief of such American seamen as are en- titled to its benefits and who are suffering from diseases or injuries. (Sec. 5, 6, Act June 29, 1870. 16 Stat., 170.) Care of foreign seamen:-Any foreign seaman, sick or disabled, may be admitted into a marine hospital for treatment and care, and the charge for the same is a lien upon the vessel to which such seaman belongs. (Sec. 5, Act May 3, 1802. 2 Stat., 193.) PAGES 15-16 MISSING REGULATIONS. I.-Assessment and collections of hospital-dues, and accounts AND REPORTS OF HOSPITAL-MONEY. Vessels subject to hospital-dues:-1. Vessels, the seamen of which are sub- ject to pay hospital-dues, are vessels of the United States engaged in the foreign trade, and enrolled and licensed vessels of the United States en- gaged in trade on the sea-coast and inland waters; but not vessels em- ployed in the fisheries, or canal-boats, except canal-boats propelled by steam or sail-power. Seameu subject to pay hospital-dues, and when:-2. The sum of forty cents per month shall be assessed as hospital-dues, and collected from all officers and seamen engaged or employed on vessels described in paragraph 1, during the time said officers and seamen are so engaged or employed, without regard to whether the vessel was in active service or in port. Who are seamen within the meaning of the act:-3. The term 11 sea- meu" embraces officers of the vessel, and all persons employed in the navigation, or in the care and preservation, of the same, and among these includes the masters or- Captains, Supercargoes, Medical officers, Pursers, Clerks, Mates, Pilots, Engineers, Quarter-masters, Gunners, Boatswains, Sail-makers, Carpenters, Watchmen, Firemen, Coal-heavers or stokers, Oilers, Water-tenders, Stewards, Cooks, Bakers, Butchers, Pantrymen, Store-keepers, Messmen, Waiters, Porters, Cabin-boys, Stewardesses, Chambermaids, Seamen, Ordinary seamen, Boys, Deck-hands, 1st class, Deck-hands, 2d class, or Roust-abouts, and Lighter-men. Stevedores and'longshoremen not included:-4. Stevedores and 'long- shoremen are not subject to pay hospital dues, and consequently are not entitled to hospital relief. 18 UNITED STATES MARINE HOSPITAL SERVICE. Reports of hospital-dues-how made:-5. A report of hospital-dues shall be made by the master or owner of every registered, licensed, or enrolled vessel of the United States, as directed by paragraph 6 or 7, as the case may be. Such report shall be made upon a form to be provided by the Treasury Department, {Form 1 or 2.) The receipt upon this form shall be filled out by the proper customs officer, in accordance with the re- port; shall then be detached and delivered to the master or owner of the vessel, who shall preserve the same with his ship's papers, subject to inspection by the proper authorities. The original report will be kept on file at the custom house where made, for the purposes directed in paragraphs 12 and 27 of these regulations. Reports of hospital-dues from registered vessels:-G. No vessel of the United States arriving in port under a register shall be admitted to entry until the master or owner has furnished to the proper customs officer a true account, under oath, of the number and names of all of- ficers and seamen engaged or employed (and the length of time they have severally been so engaged or employed,) on board said vessel since its last entrance at any port of the United States, {Form 1,) nor until said master or owner has paid to the said customs officer the sum of forty cents per month for each officer and seaman so engaged or employed. Reports of hospital-dues from coasting, lake, and river vessels:-7. In like manner as provided for registered vessels, reports {Form 2,) shall be rendered, and hospital-dues be paid, by vessels engaged in the coast- ing trade, and on the navigable inland waters of the United States? before being granted a renewal of license or enrollment. Reports of hospital-dues on sale or transfer of a vessel:-8. In like manner as is prescribed in paragraph 6, a report of hospital-dues shall be made for any vessel, the seamen of which are subject to hospital-tax, upon the sale or transfer of such vessel, whether such sale or transfer takes place at a home port or in foreign waters; and the " hospital-dues receipt" shall be preserved by the new master or owner with his ship's papers for inspection by the proper authorities. No deductions allowed:-9. The whole time during and for which each person was actually employed and paid must be embraced in the return, (paragraphs 6-7,) without regard to whether the vessel was in service or laid up. No deductions or allowances can be made upon any pretext whatever. Verification of reports of hospital-dues:-10. For the purpose of verify- ing reports of hospital-dues, customs officers are authorized to demand of the master of any vessel an inspection of his "shipping articles," or of his bo6ks and papers, before admitting the vessel to enter, or before renewing the license or enrollment, as the case may be, or they may re- quire other reasonable proof. UNITED STATES MARINE HOSPITAL SERVICE. 19 Penalty for making a false report:-11. The master or owner of any vessel, the seamen of which are subject to hospital-tax, who shall make a false return of the number of officers and seamen engaged or employed on his vessel, or of the length of time they have severally been engaged or employed since the date of the last return of hospital-dues, shall for- feit and pay a penalty of fifty dollars, (as provided by section 2, of the marine hospital act, approved June 29, 1870, 16 Stat., 169,) which sum shall be levied and collected by the customs officer to whom the report is made, subject to protest and appeal as in other customs penal- ties. The amount so collected must be deposited in the Treasury, to the credit of the marine hospital fund. Customs officers' monthly abstract of hospital-dues reports:-12. Cus- toms officers who have made collections of hospital-money during any month will, at the close of the mouth, make an abstract of the several reports of hospital-dues, and forward the same to the Marine Hospital Bureau, accompanied by a certified copy of each report of hospital-dues, (Forms 1-2.) Customs officers' accounts of hospital-money:-13. All customs officers who collect hospital-dues will keep separate accounts of the hospital- money received by them on this account and deposit the same in the nearest United States depository, as "receipts from hospital-duesand will make monthly reports of all such collections to the Marine Hospital Bureau of the Treasury Department. Deposits of hospital-money collected:-14. At ports where there is an assistant treasurer, or designated depositary, deposits of hospital-money will be made daily. At other ports the amounts collected will be depos- ited with the nearest legal depositary of Government moneys at the close of each month. Customs officers' monthly account-current of hospital-money:-15. Cus- toms officers will make an account-current (Form 4) at the close of each month of all hospital-money collected during the month to which the account relates, and will forward the same to the Marine Hospital Bureau, with the abstract and vouchers provided for in paragraph 12. When there are no collections or deposits:-16. When, at any port, there are no collections of hospital-dues, or deposits of hospital-money, during any month, the customs officer of such port will, at the close of the month, forward the blank account-current, (Form 4,) with the in- dorsement across the face thereof: No transactions. Consular officers to collect hospital-dues:-17. Consular officers of the United States will assess and collect hospital-dues from all vessels of the United States sold or transferred within their respective consular districts.-(Act April 29, 1864. 15 Stat., 61.) 20 UNITED STATES MARINE HOSPITAL SERVICE. Reports of hospital-money collected by consular officers :-18. Consular officers of the United States will, by authority of the Secretary of State, keep separate accounts of hospital-money collected by them, and make reports of the same to the Secretary of the Treasury Department, in like manner as directed for customs-officers, except that said reports will be made quarterly, and will be forwarded through the Department of State. II. Application of the marine hospital fund for the relief OF SICK AND DISABLED SEAMEN. Object of the marine hospital fond:-19. The object of the assessment and collection of hospital-dues is to provide a fund to defray the expense of medical or surgical relief, when needed by the contributors thereto, and for their maintenance, nursing, and care while necessarily under- going such treatment. Fund to he expended under the supervision of the Supervising Surgeon:-20. The fund resulting from th ecollection of hospital-dues is to be expended, under the supervision of the Supervising Surgeon, for the relief of such seamen of the United States as are entitled to its benefits, and who are suffering from diseases or injuries. Only temporary relief contemplated:-21. The law providing for the disbursement of the marine hospital fund having been uniformly con strued as intended to provide temporary relief, and not for the con- tinued care of seamen permanently disabled, it is the duty of officers having authority to grant hospital relief to exercise such authority in accordance with this construction. Seamen who are entitled to hospital relief:-22. A seaman to be entitled to relief from the marine hospital fund must have served on a regis- tered, enrolled, or licensed vessel of the United States for at least two months immediately preceding his application for aid, and must have paid hospital-dues for that period of time: Provided, That when an in- terval has occurred in the applicant's seafaring service by reason of closure of navigation, it shall not be considered as excluding him from relief, except the sickness or injury for which he applies for relief is the result of employment on shore. Nor shall the phrase " immediately preceding his application" be held as excluding a seaman who has been but a few days away from his vessel, and who has not abandoned his vocation as seaman for any other employment; nor as excluding a seaman who may have been not more than three months away from his vessel, provided it is satisfactorily shown that such absence was due to sickness. Indigent seamen, not sick or disabled, not entitled to relief23. Indi- gent seamen, not sick or disabled, and those who do m5t require medi- cal or surgical treatment in hospitals as an essential to cure, are not entitled to relief from the fund. UNITED STATES MARINE HOSPITAL SERVICE. 21 Seamen who have abandoned their vocation not entitled to relief:-24. A seaman who has engaged in any vocation on shore daring a period of two months, and who is not debarred from shipping by reason of sick- ness or disability, or by closure of navigation, has forfeited his claim to hospital relief. Masters of vessels to furnish certificates of seamen's service:-25. Mas- ters of vessels of the United States, the seamen of which are subject to hospital-tax, shall furnish any such seaman, on demand, with a certificate of the length of time the person described in such certificate has paid hospital-dues, {Form 5.) This certificate will be filed in the custom- house upon application being made for relief. Manner of obtaining hospital relief:-26. A sick or disabled seaman, to obtain hospital relief, must apply to a surgeon of the marine hospital service, or to the proper customs officer, if there be no surgeon on duty at the custom-house, and must furnish satisfactory evidence that he has paid hospital-dues for the length of time prescribed in paragraph 22. (Such evidence is, usually, the certificate of the master of the vessel on whch the applicant last served.) When there is a surgeon on duty at the custom-house, he will make the examination directed, and follow the instructions contained in paragraph 29, and will issue the permit direct- ed in paragraph 30. (See paragraph 31.) Verification of masters' certificates, etc.:-27. Care will be taken to verify the genuineness of the signatures attached to masters' certifi- cates, and relief will not be granted in any case where the signature is found to be false. When an applicant for relief claims to have paid hospital-dues and is unable to obtain his captain's certificate, the hospital-dues report of his vessel, on file in the custom-house, will be ex- amined, for the purpose of verifying the statement of the applicant. Whenever a seaman is granted relief on other evidence than the master's certificate, a memorandum of the evidence, with the necessary reference to the same, will be made and signed by the surgeon, or, in his absence, by the proper customs officer, and will be filed in the proper order, in- stead of Form 5, for inspection. Customs officers to send to surgeons for examination:-28. When, in the absence of a surgeon of the marine hospital service, a customs officer receives the application for, and is satisfied that a seaman is entitled to, relief, he will send the applicant to the surgeon in charge of marine patients at the port, with a letter (and blank certificate attached- Form 6,) requesting that an examination of the case be made. Instructions to surgeons relative to certificate of examination:-29. The surgeon will examine the applicant and fill out the certificate at- tached to Form 6. In case the seaman does not require treatment in hospital as an essential to a cure of the disease or injury from which he 22 UNITED STATES MARINE HOSPITAL SERVICE. is suffering, the surgeon will furnish a prescription, should one be needed, and indorse a copy of the same on the outer middle fold of the blank certificate, which copy will then become a voucher for one dollar- In case the seaman requires treatment in hospital as essential to a cure, the surgeon will state the probable length of time which will be required to effect a cure, and will forward the certificate to the customs officer. Permits for hospital relief issued only when recommended by a sur- geon :-30. Upon receipt of the surgeon's certificate, the customs offi- cer will, if hospital relief is recommended, issue a permit (Form 7,) in accordance with the recommendation of the surgeon, and send it to the person who is to have charge of the seaman, with the certificate (Form 6,) inclosed in the permit. Surgeons at certain ports to sign permits, etc.31. At ports where there is a surgeon of the marine hospital service on duty at the cus- tom-house, that officer will fill out and sign the certificate and permit, (Forms G and 7,) and will keep the register of permits. Numbering of permits and certificates :-32. Permits will be numbered consecutively, 1, 2, 3, &c., from July 1, to June 30, of each year, and the number given to a permit will be indorsed on the appropriate certi- ficate (Form 6,) which will be inclosed in the permit. Register of permits:-33. There will be kept in the custom-house a register of all permits issued, to be made iu the following form: Register of Permits. Permit. Name of patient. Name of vesseL Hospital-dues- length of time paid. Disease or injury. Date of dis- charge. Remarks. No. Date. Period of duration of permit:-34. The permit will state definitely the length of time for which hospital-relief is authorized, basing the same upon the statement iu the surgeon's certificate; but in no case shall any permit be issued for a period exceeding two (2) months. Extension of permits:-35. One week prior to the expiration of a per- mit, which it is necessary and proper to renew, the surgeon should make application to the Marine Hospital Bureau for extension of the same. This application must set forth the actual condition of the patient for whom extension of hospital relief is desired; the facts relating to his disease or injury; the additional period for which relief will probably be required; and the length of time the patient has paid hospital-dues, as nearly as can be ascertained. UNITED STATES MARINE HOSPITAL SERVICE. 23 The permit the only authority for relief:-36. The permit (Form 7) is the only authority for the care of a seaman that will be recognized by the Department. All permits, before they are delivered to the appli- cant, must be inclosed in an envelope, securely sealed and addressed to the person who is to have charge of the patient. When a permit is de- livered to a seaman, he should be informed that, if the same is not pre- sented on the day it is issued, it will be forfeited. Surgeons to receive permits only on the day issued:-37. Surgeons will not receive permits bearing date anterior to the day when presented, except in the cases provided for in paragraph 38. When a seaman may be received into hospital without a permit:-38. When a seaman, who is entitled to relief, makes application for a per- mit after the custom house is closed for the day, the surgeon in charge of the marine patients at the port where such application is made may receive the applicant into hospital, should the case be an urgent one, but in such case the surgeon will report the fact at the custom-house on the following day and present the master's certificate. In the event of failure to report on the following day, the permit will be dated from the day when such report is made. When a permit may be antedated:-39. In no case will a permit be antedated, except as provided in the foregoing paragraph, and then only to cover one working-day, that is, one day exclusive of legal holidays. When the charge for care of a patient shall commence:-40. The charge for the care and treatment of a seaman in hospital shall commence from the date of the actual entry of the patient into hospital. Disposition of the permit and certificate when relief is terminated41 When a patient is discharged, dies, or otherwise leaves the hospital, the surgeon who has attended him shall fill out the certificate on the outer middle fold of the permit, (Form 7,) and return the same, with the sur- geon's certificate of examination (Form 6) inclosed, to the proper cus- toms officer within twenty-four (24) hours after the patient leaves the hospital. (See paragraph 105.) Seamen not enitled to re-imbursement:-42. A seaman is not entitled to re-imbursement for expenses incurred by himself on account of sick- ness or injuries. Expense of caring for a sick seaman during a voyage:-43. It has been decided by a Circuit Court of the United States, (Harden vs. Gordon, 2 Mas. C. C. Epts., 541,) that the expense of caring for a sick seaman in the course of a voyage, is a charge on the vessel by the maritime law ; and in this charge are included not only medicines and medical advice, but nursing, diet, and lodging if the seaman is carried ashore. No sea- man, therefore, taken sick or disabled in the course of a voyage or en- gagement, is entitled to the benefits of the marine hospital fund, except at those ports where provision has been made for such purpose. 24 UNITED STATES MARINE HOSPITAL SERVICE. Care of sick seamen landed or abandoned:-44. When a seaman, sick or disab1ad in the discharge of his duty through no fault or willful neglect of his own, is lauded and abandoned at a port where no customs officer is stationed, or where, from any other reason, it is impracticable to pro- vide relief from the marine hospital fund, such seaman, or the person who takes charge of him, may recover from the vessel from and by which he was landed and abandoned, the amount of the expenses in- curred for his care, food, lodging, medicines, and medical attendance, and the charge for such expenses may be enforced by a libel against the vessel. Care of sick seamen at ports where no arrangement exists:-4:5. At ports where no arrangement exists for the care of sick or disabled seamen, customs officers will make reasonable effort to arrange for their care, in a local hospital, should there be one, or with some physician of good professional standing, should there be no hospital. Proposals for the care of sick seamen will be transmitted to the Marine Hospital Bureau for approval by the Secretary of the Treasury, and no arrangement will be valid without such approval first obtained. The following is the form of proposal: Proposal for the Care of U. S. Marine Hospital Patients, (Place.) (Date.) 187-. To the Supervising Surgeon of the U. S. Marine Hospital Service: Sir : I (or we) agree to receive all sick and disabled seamen sent to me (or us) with a permit from the proper officer at this port, except those suffering from contagious diseases, and to furnish them with good and sufficient quarters, subsistence, medical attendance, nursing, and necessary medicines, until they are able to be discharged, at the rate of per day for each patient, and to .make the reports required by, and in all other respects to conform to, the Regulations of the U. S. Marine Hospital Service, as far as the same may be decided applicable by the Supervising Surgeon. I (or we) also agree to provide, in like manner, for the care of seamen afflicted with contagious diseases, in a place* removed from the other patients, at the rate of per day for each patient. This agreement is made for the fiscal year ending June 30th, 187-. Respectfully, We guarantee the faithful performance of the above in all its terms. The above offer is bona fide, and the securities are ample. Collector. * Each city and village usually has some place provided for the care of persons suffering from con- tagious diseases, and where such provision is made, it is desirable, for the protection of the public health, that seamen with contagious diseases should be cared for in the same place provided for others suffering like affliction. UNITED STATES MARINE HOSPITAL SERVICE. 25 Transportation of seamen to hospitals:-46. At the smaller ports, where it is impracticable to provide hospital relief, authority may be.given to furnish transportation, for sick seamen, to the nearest hospital.where provision is made for such relief. Before furnishing transportation, how- ever, the customs officer must obtain a physician's certificate that treat- ment in hospital is necessary to a cure, and will transmit the certificate as a voucher to the transportation account. Relief of seamen at their own homes:-47. Seamen will not be furnished relief at their own homes except in such cases as are specially author- ized by the Department, and then an allowance for medical attendance and medicines only will be authorized. Hospital relief to foreign seamen:-48. Sick or disabled seamen belong- ing to any foreign vessel may be admitted to United States marine hospitals, (class I,) when it can conveniently be dotie, upon the applica- tion of the commander of the foreign vessel to which such seamen may belong, or upon the application of a foreign consul, and each foreign sea- man so admitted shall be subject to a charge of seventy-five (75) cents per day.-(Sec. 5, Act May 3, 1802, 2 Stat., 193. See also paragraph 105 of these Regulations. III.-Organization of the United States Marine Hospital Service. Organization of the corps of medical officers:-49. The medical officers of the United States marine hospital service shall consist of a Supervis- ing Surgeon, Surgeons, and Assistant Surgeons. The Supervising Surgeon :-50. The Supervising Surgeon, who is the official head of the Bureau of the United States marine hospital service attached to the Treasury Department, is charged by law with the super- vision of all matters connected with the service, including the disburse- ment of the fund. Surgeons and assistant surgeons:-51. Surgeons and assistant surgeons of the marine hospital service will be appointed by the Secretary of the Treasury on the recommendation of the Supervising Surgeon. Applicants for appointment to be examined by a board of surgeons52. As a requisite to recommendation for appointment in the corps of sur- geons the applicant must have been graduated as doctor in medicine from some respectable medical college, and must pass a satisfactory ex- amination before a board of surgeons, which-will be convened from time to time by the Supervising Surgeon. Surgeons and Assistant Surgeons to draw pay only when on duty-53. Surgeons and assistant surgeons will be paid only for the period while assigned to duty or under orders. 26 UNITED STATES MARINE HOSPITAL SERVICE. IV.-Hospitals for seamen, their organization, etc. Classification of hospitals for seamen:-54. For the sake of convenience, hospitals in which seamen are relieved are divided into two classes, viz: Class I. Comprising United States marine hospitals. Class II. Comprising local hospitals, devoted exclusively, or in part, to seamen, at fixed rates authorized by the Department. Relief at ports where there are no hospitals :-55. Relief will also be provided at ports where there are no hospitals, when it can consistently be done, (see paragraphs 45-46, of these Regulations.) Assignment of surgeons to United States marine hospitals, Class I56. At each United States marine hospital (Class I) one medical officer will be assigned to duty as surgeon in-charge; and where the extent, or exigencies, of the service make it necessary, one additional medical officer will be assigned as assistant, in which event one of the two medical officers shall be on duty at the custom-house during the hours when it is open for the transaction of business, to perform the duties prescribed for such officer in these Regulations, paragraphs 26-31, inclu- sive. Assignment of surgeons to hospitals, Class II:-57. At large ports, where no United States marine hospitals are established, a medical officer will be assigned to duty at the custom house, when the extent of the service makes it necessary; and his duties shall be to examine applicants for admission to hospital: to prescribe for such cases as do not require treatment in hospital; to till out the certificate, {Form 6,) and issue the permit, {Form 7,) when one is required; to examine all applicants for extension of relief from time to time ; to inspect the hos- pitals whereto seamen are admitted; to keep the register of permits; and to supervise all transactions relating to the service at the port where he is stationed. Stewards, matrons, and other employees of marine hospitals, Class I 58. There shall be in United States marine hospitals, class 1, a stew- ard, and when necessary a matron, both to be appointed by the Secre- tary of the Treasury, upon the recommendation of the surgeon of the hospital, approved by the Supervising Surgeon ; also, when needed, a principal nurse, a messenger, a cook, a watchman, (who shall also act as night nurse,) and such other employees as may be deemed necessary, all to be appointed by the surgeon, subject to the approval of the De- partment. The steward will be required to give bonds in the sum of one thousand (1,000) dollars for the faithful performance of his duties. When an engineer is necessary he will be appointed by the Secretary of the Treasury, on the recommendation of the Supervising Architect. UNITED STATES MARINE HOSPITAL SERVICE. 27 When additional employees will be authorized:-59. Additional nurses, cooks, and laundresses will be authorized when required. The usual basis for such additional help will be: One additional nurse for every twenty patients beyond the first twenty; one additional cook, and one additional laundress, when the number of patients exceeds thirty. Apothecary:-60. A prescription clerk or apothecary will be appointed by the Department, if the number of patients is such as to render it necessary. Surgeons to notify the Department of changes of employees61. Sur- geons in charge of United States marine hospitals will notify the Ma- rine Hospital Bureau of any changes they may make in the personnel of the employees, and will give reasons for such changes. Compensation of officers and employees :-62. The compensation of offi- cers and employees of the marine hospital service will be fixed by the Department. Surgeons and assistant surgeons will be provided with furnished apartments, fuel, and lights, when it can be done with con- venience; but they will, unless otherwise authorized by the Depart- ment, supply subsistence for themselves, families, and household help. Stewards, matrons, and other employees described in paragraphs 58-60, of these Regulations, will be subsisted by the hospital to which they are attached ; but other persons not included in said paragraphs, who are specially authorized to live in hospital, and are furnished subsistence, will be charged to cover the cost of the hospital ration. Surgeons to have authority over all officers and employees63. The surgeon in charge of a marine hospital shall have authority over all officers and employees of the hospital, and is empowered to enforce such regulations as he may deem necessary for the proper management and discipline of the hospital, subject to the approval of the Supervising Surgeon. Assistant surgeons, authority of:-64. When an assistant surgeon is on duty with a surgeon he shall be subject to the orders of the latter; but when serving alone he shall have the authority, and perform the duties, of a surgeon, and shall be alike accountable to the Department. Surgeons to examine applicants for relief, etc.:-65. It shall be the duty of the surgeon in charge of a marine hospital (unless provision for such duties is otherwise made in these Regulations, as in paragraph 56, q. r.,) to examine all applicants for relief, and furnish the necessary certificates as to their condition, etc.; to prescribe for such seamen as do not require treatment in hospital, (see paragraph 29;) to visit all the patients in hospital at least once each day, and oftener if necessary; to see that his prescriptions and orders for diet are properly filled, and that all the officers and employees of the hospital perform their allotted duties. 28 UNITED STATES.MARINE HOSPITAL SERVICE. Surgeons held responsible for administration of hospital, etc:-66. The surgeon will be held responsible for the proper and economical adminis- tration of the hospital under his charge, and for the care and preserva- tion of the building, furniture, and stores. Records to be kept by surgeons in charge of marine hospitals67. Sur- geons in charge of United States marine hospitals shall keep the follow- ing records, which shall be open at all times for inspection : Register of patients, prescription and diet-boolc, casebook, record of official com- munications sent. Register of patients :-68. The register of patients shall contain the number of permit, name, age, and nativity of each patient admitted to hospital; name of vessel on which last service was performed; date of admission to hospital; disease or injury; subsequent complications; date of discharge or death ; condition on leaving hospital; and num- bei' of days of relief furnished. Prescription and diet-book:-69. In the prescription and diet-book shall be entered each prescription in full, the time of administering the medi- cine, and the quantity to be given at each time, together with the names and quantities of special articles of diet. Case-book :-70. A record of all important cases, of the treatment pursued in each, and of the results, shall be kept iu the case-book. Record of official communications sent:-71. In the record of official communications shall be kept accurate copies of all official communica- tions sent. Preservation of official communications received:-72. All official com- munications received shall be preserved in a files-book, kept for that purpose, and properly indexed. Money and valuables of patients to be taken care of by surgeons:-73. Upon the admission of a patient into hospital he shall deliver his money and other valuables into the hands of the surgeon, who shall give a re- ceipt therefor. Upon the discharge of the patient from hospital his money and other effects shall be returned to him, and the receipt taken up and filed. On the death of a patient in hospital, notice to receive his effects shall be given, by letter or otherwise, to his nearest known rela- tive ; and when said effects are delivered a receipt shall be taken there- for and filed, as in the former case. If the effects are not called for within three months after such notice, an inventory, showing the pro- bable value of the same, will be forwarded to the Marine Hospital Bu- reau for instructions as to their disposition. (See paragraph 71, as to care of patients' clothing, etc.) Stewards, duties of:-71. It shall be the duty of the steward, acting under the direction of the surgeon, to procure the subsistence UNITED STATES MARINE HOSPITAL SERVICE. 29 supplies and keep a record by weight and measure of all the stores re- ceived, and also of the stores issued each day to the cook or patients, and to make a monthly report of the same as hereinafter directed. In issuing articles of special diet he will adhere strictly to the instructions written in the diet-book. He shall also keep an inventory of all public property and furniture belonging to the hospital not herein otherwise provided for, and an inventory of the effects, excepting money and valu- ables, of all patients admitted to hospital. The patient's inventory shall also show the name and address of the patient's nearest known relative. If there be no matron, he shall keep an inventory of all articles of bed- ding and hospital clothing. Apothecaries, duties of:-75. The surgeon shall cause to be kept by the apothecary, or the person acting as such, an inventory of all medi- cines, medical supplies, and instruments belonging to the hospital. The apothecary shall put up the medicines intended for each ward separately, and shall label each bottle or package with the name of the patient for whom it is intended, together with directions for taking or applying the same. Record of liquors consumed :-76. A record of allliquors usedina United States marine hospital shall be kept by the apothecary, or person acting as such, showing the amounts consumed daily of each kind. Matrons, duties of:-77. The matron, when one is employed, shall have charge of, and keep in repair, the bedding and hospital clothing, and shall keep an inventory of the same. Subsistence supplies, how obtained :-78. The ordinary and .regular sub- sistence supplies for United States marine hospitals will be obtained by contracts, to be made for one year, commencing on the first day of July of each year, and ending on the thirtieth day of June following. On the first day of May, of each yeqr, the surgeon in charge will for- ward to the Marine Hospital Bureau an .estimate, based upon the average number of patients, of the quantities of the following-named articles of subsistence likely to be required for his hospital, for the ensuing year: Beef, (fresh and corned,) ham, bacon, mutton, chickens, fish, (fresh and salt,) eggs, butter, milk, cheese, flour, bread, cracked wheat, corn-meal, hominy, rice, beans, peas, potatoes, cabbage, onions, carrots, turnips, parsnips, beets, tea, coffee, sugar, (white and brown,) molasses, salt, vinegar, pickles, ice, and, when horses or cows are kept, forage. Approved requisitions for subsistence to be submitted to merchants for bids :-79. On the approval of the. subsistence requisition, by the De- partment, it will be returned to the surgeon, who, upon receipt of the same, will fill out at least three blanks for proposals, {Form 8,) for each class of articles, viz : meats, vegetables, groceries, and forage ; and will submit copies of each to at least three merchants, dealing in 30 UNITED STATES MARINE HOSPITAL SERVICE. the articles named. Upon receipt of the various bids, which must be in sealed envelopes, they will be opened by the proper customs officer in the presence of the surgeon and of such of the bidders as may be pres- ent. They will then be transmitted to the Marine Hospital Bureau by the customs officer, indorsed with his recommendation. Articles of subsistence not provided for by contract, how obtained: - 80. Articles of subsistence not provided for by contract will be purchased, by direction of the surgeon, in open market; and the bills for the same will be transmitted, at the close of each month, through the customs officer, to the Marine Hospital Bureau, for examination and approval, before payment is made. Monthly report of subsistence stores, received, used, etc.:-81. At the close of each month the steward shall make a report (Form 9) of the subsistence stores on hand, received and expended during the month, and remaining at the close, which report the surgeon shall indorse and forward to the Marine Hospital Bureau. Horses and cows-when authorized:-82. When horses or cows are needed for the use of the hospital, they will be authorized; but no officer or employee will be allowed to keep within the hospital inclosure any horse or cow for his own use. Fuel, lights, and water-requisitions for:-83. Requisitions for fuel, lights, and water will be made on customs officers. Medical supplies :-84. The standard for medical supplies will be the U. 8. Marine Hospital Medical Supply Table, (see Appendix A.) This will be used as a guide in making requisitions for supplies; but it is not intended to confine medical officers either to the articles or to the amounts specified. To permit the indulgence of individual preferences, and to provide for the exigencies of climate, seasons, epidemic diseases, etc., a supplementary list of medicines is also given, which may be added to at the discretion of the medical officer, in accordance with paragraph 86. Requisitions for Medical Supplies:-85. Requisitions for medical sup- plies (Form 10) will be made semi-annually on the 30th of June, and on the 31st of December, of each year, and will be forwarded, in dupli- cate, to the Marine Hospital Bureau. Medicines not on the supply-table, or requisitions for unusual amounts: -86. In case any article not on the supply-table, or an amount in excess of the standard allowance, shall be asked for, the reason for such requi- sition will be stated, either on the requisition, under Remarks, or in an accompanying letter. UNITED STATES MARINE HOSPITAL SERVICE. 31 Miscellaneous articles and medicines required to be replenished-how obtained :-87. Articles not enumerated on the outfit list, (see Appendix B,) and miscellaneous articles, as well as those named on the supply- table, which are required to be replenished at any time between the regular semi-annual requisitions, will be obtained on special requisition, {Form 11,) which will be made in duplicate and separately submitted, by the surgeon making the requisition, to at least two responsible mer- chants, with a request to name the price for which they will agree to furnish each article. Articles of different classes or characters will not be grouped on the same special requisition. The reason for requiring separate requisitions for different classes of articles is obvious. Requisitions must be approved before purchases are made 88. Special requisitions {Form 11,) with prices, will be forwarded to the Marine Hospital Bureau for approval, before purchases are made. Annual property kept by surgeons :-89. Surgeons accountable for hos- pital property will make out a report of the same {Form 12,) on the 30th day of June of each year, showing the amount of each article re- ceived, expended, and on hand. Non-expendable articles not to be dropped without authority:-90. No articles, except those which are authorized to be expended with the sick, will be dropped from the annual property report without authority from the Department. Loss or destruction of hospital property to be reported to the Marine Hospital Bureau:-91. In case of loss or destruction of any article which is non-expendable, the facts concerning the loss or destruction must be fully stated to the Marine Hospital Bureau before making the annual property report, and if the explanation is satisfactory an order will be issued authorizing the surgeon to drop such article from his report. A copy of the order will be transmitted with the annual property report as a voucher. Inspection of worn-out property:-92. Articles worn out, broken, or otherwise rendered unfit for use, will be invoiced and retained for in- spection. Invoices and receipts to be given when a surgeon resigns or changes sta- tion :-93. When any surgeon who is accountable for hospital property ceases to have charge of the same by reason of resignation, change of station, or otherwise, he shall furnish an invoice of said property to his successor, and forward a duplicate of the same to the Marine Hospital Bureau. The officer who receives the property will furnish a receipt to the surgeon from whom it is received, and will forward a duplicate of the receipt to the Marine Hospital Bureau. In naming articles on the invoices and receipts the same order will be observed as that followed on the annual property report. 32 UNITED STATES MARINE HOSPITAL SERVICE. Surgeon's final account:-94. The final accounts of surgeons will not be paid until their property reports have been examined by the Marine Hospital Bureau and found to be correct. Surgeons to report diseases and injuries monthly:-95. Surgeons of the United States marine hospital service, and other surgeons having charge of marine hospital patients, shall make out, at the close of each month, a classified report of diseases and injuries of seamen treated during the month, {Form 15,) and forward the same to the Marine Hos- pital Bureau. Surgeons to report surgical operations annually :-96. Surgeons having charge of marine patients shall make a report on the 30th of June of each year, of the surgical operations performed on seamen who have been under their care during the preceding twelve months, {Form 16.) The report will, as far as possible, show the following facts: Name of patient; age; description of injury or disease for which the operation was performed; duration ; whether the operation was primary, (within twenty- four hours after the injury,) intermediate, (during the acute or inflam- matory period,) or secondary, (after that period;) anaesthetics employed ; result; usefulness. V.-Disbursements of the marine hospital fund. Surgeons to make out monthly pay-rolls of officers and employees:- 97. At the close of each month surgeons in charge of United States marine hospitals shall furnish the customs officer of the port whereat the hospital is located, with a list of the officers and employees who have been engaged during the month, {Form 17.) Bills of purchases made for hospitals:-98. Duplicate bills of all purchases made on account of United States marine hospitals shall be rendered at the close of each month, indorsed by the surgeons in charge, and shall be forwarded to the Marine Hospital Bureau for approval, except in cases where the purchases have been specially authorized by the Department. Surgeons to make monthly reports of seamen treated, &c.:-99. Sur- geons in charge of United States marine hospitals shall report monthly to the Marine Hospital Bureau, through the customs officers of their respective ports, all seamen admitted, discharged, and remaining in hospital, {Form 19.) Report to he compared with the register of permits:-100. Before forwarding the surgeon's report, {Form 19,) it will be compared with the register of permits in the custom-house, and indorsed accordingly by the officer who makes the comparison. Surgeons of hospitals of class II to make monthly returns.:-101. Sur- geons in charge of hospital establishments, other than United States UNITED STATES MARINE HOSPITAL SERVICE. 33 marine hospitals of class I. wherein seamen are maintained on account of the marine hospital fund, shall make a return at the close of each month of all seamen treated during the mouth, giving the numbers of permits, names of seamen, dates of admission and discharge, number of days charged, rate and amount. This report and account, (Form 20,) will be handed to the proper customs officer to enable him to make out the summary report of transactions, (Form 21.) Surgeon's accounts to be compared with the permits and the register of permits:-102. Before forwarding the account, (Form 20,) it will be compared with the permits, and the patients in hospital will be mus- tered for examination. The comparison and examination will be made by a medical officer of the marine hospital service when one is present at the port, and in his absence by the customs officer. Bills and accounts against the fund must include name of patient or article :-103. Bills or accounts against the marine hospital fund must, in every case, include the name, if the service is rendered to a patient, or of the specific supply actually furnished. Permits and certificates to accompany monthly transcripts and ac- counts:-104. The monthly transcript, (Form 19,) and the account for maintenance of seamen, (Form 20,) will be transmitted to the Marine Hospital Bureau, accompanied by the permits, (Form 7,) of such patients as have been discharged during the month, with the surgeon's certifi- cate, (Form 6,) enclosed with the corresponding permit. Bills for the care of foreign seamen:-105. Upon the death or dis- charge of any foreign seaman from a United States marine hospital, the surgeon of the hospital shall make out a bill, in duplicate, at the rate of seventy-five cents per day; one copy of which he shall for- ward to the Marine Hospital Bureau, and the other copy he shall de- liver to the proper customs officer of the district wherein the hospital is located ; and the customs officer shall collect the amount from the consul, or commander of the foreign vessel who is responsible for the care of said foreign seaman, and shall deposit the money so received to the credit of the marine hospital fund as a repayment. When a foreign seaman is admitted to hospital on the application of a master of a foreign vessel, no clearance will be granted the vessel until the expense of keeping such seaman is paid; or, if he is still in hospital when application for clearance is made, until security is given for the payment of the amount prescribed by law.-(Sec. 5, Act May 3, 1802. 2 Stat., 193.) Customs officers to make a monthly summary report:-106. Upon re- ceipt of reports, (Forms 17 and 19, or Form 20, as the case may be,) cus- toms officers will make a summary report, (Form 21,) of the entire transactions of the marine hospital service in their respective districts, showing the condition of the same at the beginning and close of the month for which the report is made. 34 UNITED STATES MARINE HOSPITAL SERVICE. When there are no transactions :-107. When there are no transactions the fact will be endorsed across the face of the blank, and the report signed and forwarded to the Marine Hospital Bureau. Omissions to be made the subject of a special report:-108. A transac- tion omitted from the report of the month in which it occurred, will not be included in the report for any subsequent month; but will be sep- arately-reported, (on Form 21,) with a letter of explanation. Funds remitted by the Department upon receipt of reports:-109. Upon receipt of the customs-officer's report, {Form 21,) a remittance, cover- ing the amount of funds required to meet the indebtedness of the month, will be authorized. Surgeons' reports to be made promptly:-110. The remittance of ma- rine hospital funds by the Department will depend upon the receipt of the report of transactions, {Form 21;) therefore, to enable customs of- ficers to forward the same promptly, the surgeons having charge of ma- rine patients must make out the reports required of them by these Reg- ulations, and deliver the same to the proper officer, on the last day of the month, or as soon thereafter as possible. Customs officers to pay authorized bills:-111. Upon the receipt of marine hospital funds, customs officers will pay the bills and accounts authorized by the Department. Accounts-current of receipts (from the Department) and disbursements: 112. The paid bills and accounts for each month, and an abstract of the same, {Form 22,) with an account-current of receipts (from the Depart- ment) and disbursements of the marine hospital fund, {Form 23,) will be transmitted by the customs officer to the Marine Hospital Bureau. When the abstract of disbursements may be omitted:-113. When there is but one disbursement in a district during the month the abstract {Form 22) may be omitted. VI.-Official correspondence. Official communications-how transmitted:-114. Reports and official letters relating to the United States marine hospital service will be sent to the U. 8.
