CHARGE: 403(a)—when shipped, the label statement "Super Concentrated Liquid Sweetener" was false and misleading since the article was an artificial sweetener; 403(f)—the statement of ingredients, required to appear on the label, was not prominently placed thereon with such conspicuousness (as com- pared with other words, statements, designs, or devices in the labeling) as to render it likely to be read by the ordinary individual under customary condi- tions of purchase and use; and 403 (i) (2)—the article was fabricated from two or more ingredients and its label failed to bear the common or usual name of each such ingredient. The libel alleged also that the article was misbranded under the provisions of the law applicable to drugs, as reported in notices of judgment on drugs and devices, No. 6604. "DISPOSITION: On 1-4-60, Pearsen Pharmacal Co., Inc., appeared and filed an answer to the libel, a claim to the property, and an application for an order removing the cause to the S. Dist. of Fla. On 1-18-60, the claimant's motion to remove was overruled and denied by the court in an opinion which is re- ported in the notices of judgment on drugs and devices, No. 6604. Subsequently, the claimant moved that its answer and claim be dismissed. On 7-31-61, the claimant's motion to dismiss its answer and claim was granted and a default decree of condemnation and destruction was entered.
