ALLEGED SHIPMENT: On or about November 7, 1951, from Baltimore, Md. PRODUCT: 4,848 100-capsule bottles of vitamin capsules at Pittsburgh, Pa. NATURE OF CHARGE: Adulteration, Section 402 (b) (1), a valuable constituent, vitamin Bi, had been in whole or in part omitted or abstracted from the article. Misbranding, Section 403 (a), the label statement "Bach capsule con- tains: * * * Thiamine Hydrochloride (Bi) 2 Mg." was false and mislead- ing as applied to the article, which contained less than that amount of vi- tamin Bi. The article was adulterated and misbranded while held for sale after ship- ment in interstate commerce. DISPOSITION: February 2, 1954. Default decree of condemnation. The court ordered that the product be delivered to a local hospital.
