PRODUCT: 26 cases, each containing 24 1-pint, 2-fluid-ounce cans, of tomato juice at St. Paul, Minn. LABEL IN PART : (Can) "Standby Tomato Juice." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of decomposed tomato material. DISPOSITION : April 17, 1953. The Indiana Packing Co., claimant, having filed an answer denying that the product was adulterated and later having indi- cated that it did not intend to contest the matter further, judgment was entered ordering that the product be denatured for use as animal feed or be destroyed.
