PRODUCT: 93 cases, each containing 24 1-pound, 3-ounce cans, of tomatoes at Murphysboro, Ill, LABEL IN PART : (Can) "It's Good Brand Solid Pack Tomatoes." NATURE OF CHARGE: Misbranding, Section 403 (g) (2), the article purported to be and was represented as canned tomatoes, a food for which a definition and standard of identity has been prescribed by regulations, and its label failed to bear, as required by such regulations, the name of the optional in- gredient, calcium salt or calcium salts, present in the article. DISPOSITION: March 26,. 1953. Default decree of condemnation. The court ordered that the product be delivered to a charitable institution, conditioned that the product be used only by the institution.
