ALLEGED SHIPMENT: On or about August 4, 1952, by the Wheatland Elevator Co., from Bottineau, N. Dak. PRODUCT: 2,000 bushels of wheat at Duluth, Minn. NATURE OF CHARGE: Adulteration, Section 402 (a) (2), the article contained an added poisonous and deleterious substance, a mercurial compound, which is unsafe within the meaning of the law since it is a substance not required in the production of the article and can be avoided by good manufacturing practice. DISPOSITION : September 3,1952, The Wheatland Elevator Co., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for reprocessing into industrial alcohol, or feed, under the supervision of the Federal Security Agency. On September 29,1952, the decree was amended to permit the Farmers Union Grain Terminal Association, St. Paul, Minn., to be substituted as claimant and to permit the reprocessing of the product by scouring. The product involved in the instant case was commingled with the product involved in the case reported in the preceding notice of judgment, No. 19775, for the purposes of the scouring operations. 3,430 pounds of the commingled product were found unfit and were destroyed.
