ALLEGED SHIPMENT : On or about September 6,1952, by the Farmers Cooperative Creamery Assn., from Avoca, Iowa. PRODUCT: 6 cartons, each containing 65 pounds, of butter at New York, N. Y. LABEL IN PART: "Butter Breakstone Bros., Inc. Distributors New York." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), a product containing less than 80 percent by weight of milk fat had been substituted for butter, a product which is required by law to contain not less than 80 percent by weight of milk fat. DISPOSITION : October 6, 1952. Breakstone Bros., Inc., New York, N. Y., claim- ant, having admitted the allegations of the libel and consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond, conditioned that it be reworked under the supervision of the Food and Drug Administration so that it would comply with the law.
