INFORMATION FILED: May 13, 1952, Northern District of Oklahoma, against Charles A. Whitford, trading as the Whitford Mercantile Co. and the Nowata Creamery Co., at Nowata, Okla. ALLEGED VIOLATION: On or about December 28, 1940, and July 10, 1949, the defendant, at Nowata, Okla., in the names of the Whitford Mercantile Co. and the Nowata Creamery Co., gave to a firm engaged in the business of shipping butter in interstate commerce, at Carthage, Mo., guaranties to the effect that butter delivered by the defendant under the guaranties would not be adulterated. On or about August 30,1950, the defendant caused to be shipped from Nowata, Okla., to the holder of the guaranties at Carthage, Mo., a quantity of butter which was adulterated. of the article, namely, milk'fat, had been in part omitted; and Section 402 (b) (2), a product containing less than 80 percent by weight of milk fat had been * substituted for butter, which the article was represented to be.
