ALLEGED SHIPMENT : On or about October 30, 1950, from Lockport, N. Y. PRODUCT: 196 100-pound bags of flour at Burlington, Vt., in possession of the Burlington Grocery Co. LABEL IN PART : "Pride Bakery Flour." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of rodent urine and rodent hairs; and, Section 402 (a) (4), the product had been held under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION : April 9,1951. The Burlington Grocery Co., Burlington, Vt, claim- ant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for segregation of the fit portion from the unfit, under the supervision of the Food and Drug Administration, and disposal of the unfit for purposes other than for human consumption. 178 100-pound bags of the product were found to be contaminated and' were denatured for use as animal feed; the remaining 18 bags were free of contamination and were released.
