ALLEGED SHIPMENT: On or about March 21 and July 25, 1950, from Houston, Tex., and Crowley, La. PRODUCT: 735 bags, each containing 100 pounds, of rice at San Francisco, Calif. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of in- sects and insect excreta. The product was adulterated while held for sale after shipment in interstate commerce. DISPOSITION : February 13,1951. J. A. Lewis, Oakland, Calif., and Lee & Lamb, San Francisco, Calif., having appeared as claimants for 135 sacks and 600 sacks, respectively, and having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for the purpose of cleaning and fumigating, under the supervision of the Food and Drug Administration. 732 100-pound bags and 35 pounds of the product were recovered as the result of the recleaning operations. The waste material was destroyed.
