ALLEGED SHIPMENT: On or about October 13, 1950, by Southern Packing Co., Inc., from Smithsburg, Md. PRODUCT: 899 cases, each containing 24 1-pound, 3-ounce cans, of tomatoes at Hartford, Conn. LABEL IN PART: (Can) "Suncrest * * * Solid Pack Tomatoes." NATURE OF CHARGE: Misbranding, Section 403 (g) (2), the product failed to conform to the standard of identity for canned tomatoes in that the label failed to bear a statement that calcium salts had been added. DISPOSITION: January 11, 1951. Gaer Bros., Inc., Hartford, Conn., claimant, having consented to the entry of a decree, judgment of condemnation was en- tered and the court ordered that the product be released under bond for the purpose of relabeling, under the supervision of the Food and Drug Administration.
