LIBEL FILED : September 26,1950, District of New Mexico. ALLEGED SHIPMENT : On or about June 1 and 15, 1950, from El Paso, Tex., and Lamar, Colo. PRODUCT: 183 25-pound bags, 40 100-pound bags, and 176 50-pounds bags of flour, 13 5-pound bags of white corn meal, and 46 10-pound bags of yellow corn meal, at Silver City, N. Mex., in possession of the American Grocery Co. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the products consisted in whole or in part of filthy substances by reason of the presence of rodent urine; and, Section 402 (a) (4), they had been held under insanitary conditions whereby they may have become contaminated with filth. The articles were adulterated while held for sale after shipment in interstate commerce. DISPOSITION: October 23, 1950. Default decree of condemnation and destruction.
