ALLEGED SHIPMENT : On or about September 3,1949, by the Hudson-Duncan Co., from Portland, Oreg. PRODUCT: 198 cases, each containing 6 6-pound, 5-ounce cans, of green beans at Brooklyn, N. Y. Examination showed that the product was not fancy since it contained an excessive amount of tough strings and presented a ragged appearance. LABEL, IN PART: (Can) "Blue Diamond * * * Blue Lake Fancy Beans Cut Green." NATURE OF CHARGE: Misbranding, Section 403 (a), the label statement "Fancy" was false and misleading as applied to an article which was not of fancy quality. DISPOSITION: October 26, 1949. Henry Bresky & Sons, Bridgeport, Conn., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for relabeling, under the supervision of the Federal Security Agency.
