ALLEGED SHIPMENT: On or about April 1, 1949, by Clarence D. Davis, from Elmira, N. Y. PRODUCT: 211 daisies of Cheddar cheese at Montgomery, Ala. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance. Examination showed that the product was decomposed. DISPOSITION : On or about August 29, 1949. Clarence D. Davis, Inc., claimant, having consented to the entry of a decree, judgment of condemnation was en- tered and the court ordered that the product be released under bond, to be brought into compliance with the law, under the supervision of the Food and Drug Administration. Of the 4,408 pounds which were seized, 3,646 pounds were salvaged and the remainder were destroyed.
