ALLEGED SHIPMENT : On or about April 4 and 11,1949, from Knoxville, Tenn., by the Sugar Creek Creamery Co. PRODUCT: 22 cartons, each containing 44 patties, and 70 boxes, each containing 12 cartons, of butter at Middlesboro, Ky. LABEL IN PART : "Sugar Creek Butter Country Patty 8 Oz. Net" and "Sugar Creek Butter 1 Lb. Net." NATURE OF CHARGE: Misbranding, Section 403 (e) (2), the article in the re- spective lots did not contain "8 Oz. Net" and "1 Lb. Net" as labeled since analysis showed that the article was shorfweight. DISPOSITION : June 2, 1949. The Sugar Creek Creamery Co., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the court ordered that the product be released under bond for reworking, reprinting, and repacking, so that it would be brought into compliance with the law, under the supervision of the Federal Security Agency.
