ALLEGED SHIPMENT : On or about October 14, 1948, by the Wyndmere Creamery, Wyndmere, N. Dak. PRODUCT: 15 cartons, each containing approximately 64 pounds, of butter at New York, N. Y. LABEL IN PART: "Butter Distributed by J. R. Kramer, Inc., 2250 New York * * *." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy, putrid, or decomposed substance. Analysis of a sample showed the presence of an insect, insect fragments, and manure fragments. DISPOSITION: December 1, 1948. The Wyndmere Creamery, claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond to be converted into fat for soap manufacturing purposes, under the supervision of the Federal Security Agency.
