Drained Weight 5 oz." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), diluted clam juice had been substituted in part for minced clams. Misbranding, Section 403 (e) (2), the product failed to bear a label con- taining an accurate statement of the quantity of the contents. The cans bore the statement "Drained Weight 5 oz.," but they contained less than 5 ounces drained weight of clams. DISPOSITION : October 28, 1947. A plea of guilty having been entered on behalf of the partnership, and a plea of nolo contendere having been entered by F. Nelson Blount, the former was fined $250 and the latter was fined $50.
