ALLEGED SHIPMENT : On or about September 4 and 24, 1945, from Kocky Ford, Colo. PRODUCT: 27 lOO-pound bags of sugar at Atlantic, Iowa, in the possession of the Atlantic Wholesale Grocery Co. The product was stored under in- sanitary conditions after shipment. Some of the bags were rodent-gnawed, and rodent excreta and urine stains were observed on them. Examination showed that the product contained rodent excreta pellets. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION: August 7, 1946. No claimant having appeared, judgment of condemnation was entered and it was ordered that the product be delivered to a public institution to be used for purposes other than human consump- tion ; otherwise, it was to be destroyed.
