No. 18692. Sample No. 58995-F.) LIBEL FILED : September 13,1944, "Western District of Virginia. ALLEGED SHIPMENT: On or about August 19, 1943, by the Northern Illinois Cereal Co., from Lockport, Ill. PRODUCT: 50 cases, each containing 24 14-ounce cartons, of roasted oats at Lynchburg, Va. LABEL IN PART : "Gold Medal Coke Roasted Oats." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of weevils and larvae; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION: December 4, 1944. No claimant having appeared, judgment of forfeiture was entered and the product was ordered destroyed. On Decem- ber 22, 1944, an amended order was entered ordering the product delivered to a charitable institution, for use as animal feed.
