LIBEL FILED : June 30, 1944, District of Hawaii. ALLEGED SHIPMENT: On or about June 3, 1944, by Alexander & Baldwin, Ltd., from San Francisco, Calif. PRODUCT: 71 80-pound bags of pinon nuts at Kahului, T. H. VIOLATION CHARGED: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance by reason of the presence of animal excreta pellets. DISPOSITION : October 24, 1944. The Hawaiian Commercial and Sugar Co., Ltd., claimant, having admitted that the nuts were adulterated as alleged in the libel, judgment of condemnation was entered and the product was ordered released under' bond to be disposed of in compliance with the law, under the supervision of the Food and Drug Administration. The product was cleaned in order to eliminate all filth.
