ALLEGED SHIPMENT : On or about October 12 and November 28, 1944, by Draper and Co., Inc., from Milford, Del. PRODUCT: 194 cases, each containing 6 cans, of peas at Norfolk, Va., and 179 cases, each containing 24 cans, of peas at Brooklyn, N. Y. LABEL IN PART: (Cans) "Mispillion [or "Can Dandy," or "Milford"] Brand Eun of the Pod Early June Peas." VIOLATION CHARGED: Misbranding, Section 403 (h) (1), the product was below standard. DISPOSITION : February 16, 1945. Draper and Co., Inc., claimant for the Brook- lyn lots, having admitted the allegations of the libels, and the libel proceedings against those lots having been consolidated, judgment of condemnation was entered and the product was ordered released under bond to be relabeled under the supervision of the Food and Drug Administration. On March 7, 1945, no claimant having appeared for the Norfolk lot, judgment of condemna- tion was entered and the product was ordered delivered to a charitable institution.
