Sample No. 92840-F.) LIBEL FILED : November 10, 1944, District of Columbia. ALLEGED SHIPMENT : On or about February 29, 1944, from New York, N. Y. PRODUCT: 5 100-pound bags of rice at Washington, D. C, in the possession of the Terminal Refrigerating and Warehousing Corporation, Fourth Street plant. This product had been stored, after shipment, under insanitary conditions. The bags were rodent-gnawed, and rodent excreta and urine stains were observed on them. Examination showed that the article contained rodent excreta and weevils. VIOLATIONS CHARGED: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION: December 5, 1944. No claimant having appeared, judgment of condemnation was entered and the product was ordered delivered to the National Zoological Park, for use as animal feed.
