Sample No. 14748-F.) The article consisted of a finely powdered substance in a wax paper bag which was placed in a cardboard carton. The contents occupied approximately 48 percent of the volume of the carton. LABEL IN PART: (Cartons) "French-Kettle Brand Dehydrated Famous French Style Split-Pea Soup Mix Puree with Noodles." VIOLATION CHARGED: Misbranding, Section 403 (d), the container of the article was so made, formed, and filled as to be misleading. DISPOSITION: April 21, 1944. French-Kitchen Foods Corp., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered released under bond to be repackaged into bulk con- tainers and relabeled for sale to restaurants or institutions, under the supervi- sion of the Food and Drug Administration.
