VIOLATION CHARGED: Adulteration, Section 402 (a)(3), the article consisted in whole or in part of a filthy substance by reason of the presence of aphids and thrips. DISPOSITION : April 20 and May 16, 1944. The Fairmont Creamery Co. of New York, Buffalo, N. Y., having admitted that some of the product contained aphids and thrips, judgments of condemnation were entered and the product was ordered released under bond for sorting, under the supervision of the Food and Drug Administration, in order to eliminate all unfit material.
