6424. Adulteration of flour. U. S. v. 102 Sacks of Flour. Consent decree of condemnation. Product ordered released under bond. (F. D. C. No. 12184. Sample No. 66545-F.) LIBEL FILED : April 15, 1944, Western District of Oklahoma. ALLEGED SHIPMENT : On or about December 13,1943, and January 12,1944, from I Salina, Kans. PRODUCT: 102 50-pound sacks of flour at Oklahoma City, Okla., in possession of the Fleming Co. The flour was stored under insanitary conditions after shipment. The bags had been torn by rodents, and rodent nests were found in the stack of flour. Examination of samples showed that the product contained rodent excreta and rodent hairs. VIOLATIONS CHARGED: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION : May 16,1944. The Fleming Co., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered released under bond to be brought into compliance with the law under the supervision of the Food and Drug Administration. The unfit portion was segregated and denatured for use as animal feed.
