On November 27, 1942, the United States attorney for the Northern District of New York filed a libel against 83 barrels, each containing 440 pounds,^ of frozen strawberries at Albany, N. Y., alleging that the article had been shipped in interstate commerce on or about September 23,1942, by the Borden Co., Everett, Wash.; and charging that it was adulterated in that it consisted in whole or in part of a decomposed substance. On March 19,1943, the Borden Company, claimant, having admitted the allega- tions of the libel, judgment of condemnation was entered and the product was ordered released under bond conditioned that the tinfit portion be segregated and destroyed or denatured under the supervision of the Food and Drug Admin- istration.
