On August 5, 1942, the United States attorney for the Eastern District of Pennsylvania filed a libel against 5 tubs of butter, each containing 63, 64, or 65 pounds, at Philadelphia, Pa., alleging that the article had been shipped in inter- state commerce on or about August 3, 1942, by the Milford Creamery, from Mil- ) ford, " Del.; and charging that it was adulterated in that it consisted in. whole or in part of a filthy, putrid, or decomposed substance, and in that it had been prepared, packed, or Held under insanitary conditions whereby it might have becbine contaminated with filth, or whereby it might have been rendered injurious to health. ¦' ¦ V; On August 26, 1942, no claimant having appeared, judgment of condemnation was entered and the product was ordered destroyed.
