Samples of this product were found to contain rodent hairs and insect fragments. On October 27, 1941, the United States attorney for the Western District of Washington filed an information against Tasker B. Roop, trading as Sugar Crisp Cone Co. at Seattle, Wash., alleging shipment within the period from on or about March 6 to on or about March 19, 1941, from the State of Washington into the State of Oregon of quantities of chocolate-coated cones which were adulterated. The article was labeled in part: "Frozen Drumstick Chocolate Coated Cones." The article was alleged to be adulterated in that it consisted in whole or in part of a filthy substance; and in that it had been prepared, packed, or held under insanitary conditions whereby it might have become contaminated with filth* On December 1, 1941, the defendant having entered a plea of guilty, the covirt imposed a fine of $23 and costs,
