2423. Adulteration of frozen whiting:. V. S. v. 67 Boxes of Whiting. Default decree of condemnation and destruction. (F. D. C. No. 5453. Sample No. 29731-E.) On August 26, 1941, the United States attorney for the Western District of Kentucky filed a libel against 67 boxes of whiting at Louisville, Ky., alleging that the article had been shipped in interstate commerce on or about August 8, 1941, by the Great Atlantic & Pacific Tea Co. from Boston, Mass.; and charging that it was adulterated in that it consisted in whole or in part of a filthy substance. The article was labeled in part: "Produced by Gloucester Fresh Fish Co. * * * H&G (or D) Whiting.?' On September 16, 1941, no claimant having appeared, judgment of ¦>. con- demnation was entered and the product was ordered destroyed.
