On April 30, 1941,. the United States attorney for the Eastern District of Virginia filed a libel against 36 cases, each' containing 24 cans, of spinach at' Norfolk, Vai, alleging that the article had been shipped on or about November' 8, ¦ 1940, and March 11, 1941, by the H. J. Moran Co. from Baltimore, Md.; and charging that it was misbranded in that the term "Fancy" was false and misleading as applied to an article that was not Fancy because of the large amount of stems and flower buds and (14 eases only) that was also somewhat gritty. The article was labeled in part: (Cans) "Net Weight 1 Lb. 11 Oz.
