3048. Adulteration of tomato soup. IT. S. v. 5 Cases of Tomato Soup. Default decree of condemnation and destruction. (F. D. C. No. 3580. Sample No. 34702-B.) On December 26, 1940, the United States attorney for the District of Con- necticut filed a libel against 5 cases, each containing 48 cans, of tomato soup at Hartford, Conn., alleging that the article had been shipped in interstate com- merce on or about November 21, 1940, by Bruder & Zweil, Inc., from Providence, R. I.; and charging that it was adulterated in that it consisted in whole or in part of a decomposed substance. It was labeled in part: (Cans) "Contents 10% Oz. Avoir McGrath's Condensed Tomato Soup." On April 7, 1941, no claimant having appeared, judgment of condemnation and destruction was entered with provision for delivery of a sample to the Food and Drug Administration. OTHER FRUIT PRODUCTS
