846. Adulteration of blueberries. TJ. S. v. 6 Crates and 9 Crates of Blueberries. Default decree of condemnation and destruction. (F. D. C. No 2561. Sample Nos. 2673-E, 2674-E.) On August 8, 1940, the United States attorney for the District of Massa- chusetts filed a libel against 15 crates of blueberries at Boston, Mass., alleging that the article had been shipped in interstate commerce on or about August 5, 1940, by Dominic Miraldo from Tresckow, Pa.; and charging that it was adulterated in that it consisted in whole or in part of a filthy substance. The article was labeled in part: "William Penn Brand Penna Blue Berries." On September 16, 1940, no claimant having appeared, judgment of condemna- tion was entered and the product was ordered destroyed.
