Nos. 1647, 1649. Sample No. 91122-D.) This product occupied on an average about 50 percent of the capacity of the retail carton. On March 18, 1940, the United States attorney for the District of Oregon filed libels against 30 cases of candy at Astoria, Oreg., alleging that the article had been shipped in interstate commerce on or about February 8, 1940, by Hoefler's Centennial Chocolates from San Francisco, Calif.; and charging that it was misbranded in that its container was so made, formed, or filled as to be mis- leading. The article was labeled in part: "Hoefler's 50 Centennial Rum-Butter Cream." On May 7,1940, no claimant having appeared, judgments of condemnation were entered and the product was ordered destroyed or distributed to charitable institutions.
