On July 11, 1939, the United States attorney for the Middle District of Georgia filed a libel against 15 boxes and 21 cartons of candy at Macon, Ga., alleging that the article had been shipped in interstate commerce on or about September 9, 1938, and April 5, 1939, by the Paul F. Beich Co. from Chicago and Blooming- ton, Ill.; and charging that it was adulterated in that it consisted wholly or in part of a filthy vegetable substance. It was labeled in part: "Beich Dipsy Doodle Pecan Cashew Roll" ; or "Beich Whiz." On August 26, 1939, no claimant having appeared, judgments of condemnation were entered and the product was ordered destroyed.
