Sample No. 60791-D.) ;¦ On July 13, 1939, the United States attorney for the Southern District of New! York filed a libel against 10 tubs of butter at New York, N. Y., alleging that the! article had been shipped in interstate commerce on or about July 4, 1939, by 1 Fauquier Creamery Co., Marshall, Va. (member Monticello Dairy Corporation),- in pool shipment by truck from Culpeper Creamery Co., Culpeper, Va.; and i charging that it was adulterated in that a product which contained less than \ 80 percent by weight of milk fat had been substituted for butter. On July 26, 1939, no claimant having appeared, judgment of condemnation was entered and the product was ordered delivered to a charitable institution.
