30098, Adulteration and ntlsbranding of Glycopon AA. U, S, v. 1½ Gallons and 4 '1/a Gallons of Glycopon _AA. Default decree of conde111nation and destruction. (F. & D. No. 40997. Sample Nos. 48090-C, 48557-C.) This product consisted of diethylene glycol, a poison. On December 3, 19-37, the United States attorney for the District of Maryland, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of approximately 63/s gallons of Glycopon AA at Baltimore, Md., alleging that the article had been shipped in interstate commerce on or about June 15, 1937, by Glyco Products Co., Inc., from New York, N. Y.; and charging adulteration and misbranding in violation of the Food and Drugs Act. The article was alleged to be adulterated in that diethylene glycol, a poison, had been substituted for Glycopon AA, a food-flavor solvent which it purported to be. It was alleged to be misbranded in that the statement ''Glycopon AA" was false and misleading and tended to deceive and mislead the purchaser when applied to diethylene glycol, a poison ; and in that it was sold under the distinctive name of another article, namely, Glycopon AA, a food-flavor solvent. On December 5, 1938, no claimant having appeared, judgment of condemnation was entered and the product was ordered destroyed.
