28286. Adulteration of apples. IT. S. v. 23 Bushels of Apples. Default decree of condemnation and destruction. (F. & D. No. 41364. Sample No. 59626-C.) This product was contaminated with arsenic and lead. On October 8, 1937, the United States attorney for the Southern District of Iowa, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 23 bushels of apples at Des Moines, Iowa, alleging that the article had been hauled in interstate commerce on or about October 4, 1937, by G. G. Squier from Benton Harbor, Mich., and charging adulteration in violation of the Food and Drugs Act. The article was labeled in part: "Erwin Weber R Two Benton Harbor Mich." The article was alleged to be adulterated in that it contained added poison- / on or deleterious ingredients, arsenic and lead, which might have rendered it' harmful to health. On November 6, 1937, no claimant having appeared, judgment of condemna- tion was entered ordering that the product be destroyed. HARRY L. BROWN, Acting Secretary of Agriculture.
