On April 7, 1937, the United States attorney for the Northern District of Ohio, acting upon a report by the Secretary of Agriculture, filed in the district court a libel (amended June 8, 1937) praying seizure and condemnation of 102 cases of canned shrimp at Toledo, Ohio, alleging that the article had been shipped In Interstate commerce on or about February 3, 1937, by George H. Leslie & Co. from Chicago, Ill., and charging adulteration in violation of the Food and Drugs Act The article was labeled in part: (Cans) "Doll Baby Brand Wet Pack Shrimp, Best Quality, L. O. Mays Co. Inc., Distributors, New Orleans, La." It was alleged to be adulterated in that it consisted in whole or in part of a filthy, decomposed, or putrid animal substance.
