This case involved frozen eggs that were in whole or in part decomposed and putrid. On May 15, 1937, the United States attorney for the Western District of Missouri, acting upon a report by the Secretary of Agriculture, filed in the district court an information against Producers Produce Co., Inc., at Spring- field, Mo., alleging shipment by said company in violation.^ the Food and Drugs Act on or about September 26 and October 16, 23, 24, and -26,-1936, from the State of Missouri into the States of New Jersey and New York of quantities of frozen eggs that were adulterated. The article was alleged to be adulterated in that it consisted in whole or in part of a decomposed and putrid animal substance.
