On December 5,11, 12, 14, 19, and 22, 1936, the United States attorney for the District of New Jersey, acting upon reports by the Secretary of Agriculture, tiled in the district court libels praying seizure and condemnation of 263 cases of tomato paste in various lots at Jersey City, Paterson, and Newark, N. J., respectively, alleging that the article had been shipped in interstate commerce between the dates of September 14, 1936, and November 23, 1936, by the Marl- boro Canning Corporation from Marlboro, N. Y., and charging adulteration in violation of the Food and Drugs Act. The article was labeled in part: "Lola Brand Tomato Paste Color Added * * * Packed in U. S. A. by The Marl- boro Canning Corp. Marlboro, N. Y." The article was alleged to be adulterated in that it consisted in whole or in part of a decomposed vegetable substance. On January 21, 1937, no claimant having appeared, judgments of condemna- tion were entered and it was ordered that the product be destroyed. W. R. GREGG, Acting Secretary of Agriculture.
