26284. Adulteration of cream. V. S. v. One 5-Gallon Can, et al., of Cream. Con¬ sent decree of destruction. (F. & D. no. 37876. Sample no. 73922-B.) This case Involved cream that was in various stages of decomposition. On June 24, 1936, the United States attorney for the District of Colorado, lictlng upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of two cans of cream at Trinidad, Colo., alleging that the article had been shipped in interstate commerce on or about June 19, 1936, by R. A. Hamlin, from Bovina, Tex., and D. S. Harrell, from Quanah, Tex., and charging adulteration in violation of the Food and Drugs Act. The article was alleged to be adulterated in that it was yeasty, cheesy, moldy, and decomposed. On June 29, 1936, the Independent Creamery Co., the consignee, Trinidad, Colo., having filed a statement confessing the allegations of the libel and having consented to the entry of a decree, judgment was entered ordering that the product be destroyed.
