25430. Adulteration of prunes. V. S. v. Ben Greenbaum. Plea of guilty. Fine, $50. (F. & D. no. 35939. Sample no. 31504-B.) This case was based on a shipment of dried prunes which were in part decomposed. On August 31, 1935, the United States attorney for the District of Oregon, acting upon a report by the Secretary of Agriculture, filed in the district court an information against Ben Greenbaum, Portland, Oreg., alleging ship- ment by said defendant in violation of the Food and Drugs Act, on or about February 7, 1935, from the State of Oregon into the State of Washington of a quantity of prunes that were adulterated. :the article was alleged to be adulterated In that It consisted in part of a flithy and decomposed vegetable substance. On December 8, 1935, the defendant having entered a plea of guilty, a fine of $50 was Imposed. Payment of fine was suspended and the defendant was placed on probation for 3 years.
