23329. Adulteration of canned shrimp. U. S. v. 16 Cases of Shrimp. De¬ fault decree of condemnation and destruction. (F. & D. no. 33638. Sample no. 19710-B.) This case involved' a shipment of canned shrimp which was found to be in part decomposed. On October 10, 1934, the United States attorney for the Southern District of Ohio, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 96 cases of canned shrimp at Cincinnati, Ohio, consigned August 25, 1934, alleging that the article had been shipped in interstate commerce by the Dorgan-McPhillips Packing Corp., from Biloxi, Miss., and charging adulteration in violation of the Food and Drugs Act. The article was labeled in part: (Can) " White Villa Fancy Shrimp * * * White Villa Grocers Co., Inc., [or " The Cincinnati Wholesale Gro- cery Co."] Distributors Cincinnati, Ohio, Dayton, Ohio." The article was alleged to be adulterated in that it consisted in whole or in part of a decomposed animal substance.
