22224. Adulteration of canned tomato puree. U. S. v. Holley Canning: Go. Plea of guilty. Fine, $25. (F. & D. no. 31412. Sample no. 32137-A.) This case was based on an interstate shipment of canned tomato puree which contained excessive mold. On February 5, 1934, the United States attorney for the Western District of New York, acting upon a report by the Secretary of Agriculture, filed in the district court an information against the Holley Canning Co., a corporation, Holley, N. Y., alleging shipment by said company in violation of the Food and Drugs Act, on or about April 4, 1933, from the State of New York into- the State of Pennsylvania, of a quantity of canned tomato puree which was adulterated. The article was labeled in part: " HoUeyripe Brand Puree To- matoes HCCo. Packed by Holley Canning Co., Holley, N. Y." It was alleged in the information that the article was adulterated in that it consisted in part of a filthy and decomposed vegetable substance. On April 3, 1934, a plea of guilty was entered on behalf of the defendant company, and the court imposed a fine of $25. M. L. WILSON, Acting Secretary of Agriculture.
