21811. Misbranding of Dr. Schwind's Rose Healing: Sal-re. TJ. S. v. 26 Boxes of Dr. Schwind's Rose Healing: Salve. Default decree or condemnation and destruction. (F. & D. no. 30599. Sample no. Examination of the drug preparation involved in this case disclosed that it contained no ingredient or combination of ingredients capable of producing: certain curative and therapeutic effects claimed in the labeling. On June 20, 1933, the United States attorney for the District of South Dakota, acting upon a report by the Secretary of Agriculture, filed in the dis- trict court a libel praying seizure and condemnation of 26 boxes of Dr. Schwind's Rose Healing Salve at Sioux Falls, S.Dak., alleging that the article had been shipped in interstate commerce on or about May 16, 1933, by the Schwind Laboratories, from Sioux City, Iowa, and charging misbranding in violation of the Food and Drugs Act as amended. Analysis of a sample of the article by this Department showed that it con- sisted essentially of a lead compound incorporated in a fat. It was alleged in substance in the libel that the article was misbranded in that the following statements, appearing on the carton and jar labels, falsely and fraudulently represented that the article was effective in the diseases and conditions named therein: (Carton) "Healing * * * it has no equal for the treatment of wounds, sores * * * infection, piles, * * * rashes, * * * fruit bite, etc. * * * the affected part * * * healing * ' * * for Wounds, Sores, * * * piles, blood poison, boils, rashes, etc. * * * healing * * * heals wounds, sores, * * * piles, etc. * * * heal- ing"; (jar cap) "Healing." On September 30, 1933, no claimant having appeared for the property, judg- ment of condemnation was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
